An Analysis of Procedural Problems under the DSU Retaliation Regime

국문 초록

WTO분쟁해결제도하에서는 제소국이 피소국에 대하여 양허 또는 그 밖에 의무를 정지(아래 보복조치 라 약칭함)할 수 있도록 허용하고 있다. 분쟁해결양해(DSU)는 일반 분쟁해결절차를 규정하고 었으며 또한 보복조치의 적용과 관련된 이슈도 규율한다. 그러나 보복조치의 적용관행에 있어 DSU가 다루지 못한 몇 개의 절차적 문제점이 있다. 이러한 문제점틀은 분쟁해결절차의 어느 단계에 해당하느냐에 따라 보복조치 발동의 사전단계 (pre-retaliation stage) 및 사후단계(post-retaliation stage)로 나누어 각각 검토한다. DSU 제21.5조와 제22조간의 관계를 속발적 이슈( sequencing issue) 라고 하는데, 그 문제는 보복조치 발동의 사전단계에서 발생한다. 속발적 이슈는 각 사건마다 임시적으로 (ad hoc solution)해결해 왔으나SU 개정 또는 WTO 각료회의냐 일반이사회의가 채택한 해석을 통한 해결책이 필요하다. 소위 회전식 보복조치( carousel retaliation) 및 설시중인 보복조치의 종료와 같은 이슈도 역시 DSU의 범위에서 누락된 문제들이다. 따라서 WTO 회원국과 학자들은 이러한 이슈들에 대한 해결책을 위해 여러 가지 개선방안을 제시하고 있다.

영문 초록

Under the WTO dispute settlement system, an aggrieved Member is entitled to a number of remedies which include the possibility of a suspension of concessions or other obligations ( retaliation ) vis-à-vis a defaulting Member. The DSU provides a legal framework for retaliation under the general dispute resolution regime. It sets forth several principles and procedures for invocation of retaliatory actions, and WTO s reaction to such invocation. However, the practice of utilization of retaliatory sanctions has revealed certain gaps in the existing rules with respect to some important procedural issues. Depending on the temporal aspects of these issues, one can distinguish a pre-retaliation stage and a post-retaliation stage. The sequencing issue - the problem of the Article 21.5/ Article 22 relationship under the DSU - has arisen at the pre-retaliation stage on a number of occasions. Ad hoc solutions have cured this procedural difficulty, but they are not preferred to a desirable permanent solution in the form of either a DSU amendment or a multilateral interpretation. The carousel retaliation involving rotation of the targeted products on a retaliation list and the absence of formal procedures for termination of retaliation are problems of the post-retaliation stage which have also been left out of the DSU scope. As a result, a number of proposals have been tabled by both Members and academics with a view to bridging the gap in the existing rules and procedures.
