국화(國花) 무궁화의 법제화에 대한 연구

국문 초록

본고는 국회(國花)에 관한 법률안 제정의 필요성을 탐구하고, 또 그 쟁점 사안에 대한 대안을 모색해 보는 것을 목적으로 한다, 국화 관련 법률안은 16대부터 19대 국회까지 총 9회(개별 법안 6회, 국가상징 통합 법안 3회)에 걸쳐 제안되었는데 모두 논의가 제대로 이뤄지지 못한 채 해당 국회 임기만료로 자동 폐기되었다. 국화에 관한 법률안 제정의 필요성을 알아보기 위해 법률안별 제안 이유, 전문가 검토 의견, 정부 측 의견, 국민과 민간단체 의견, 통일 후 국가상징 통합문제에 대한 대비 등을 탐구하여 그 필요성을 12가지로 제시하였다. 그리고 국회에서 법률안 논의 과정에서 그동안 반복적으로 제기된 쟁점이 두 가지인 것을 확인하고, 이에 대해 ① 국가상징 통합 법안보다는 국화에 관한 개별 법안이 보다 적정하고, ② 국화로서 무궁화의 기준형(품종) 선정 관련해서는 1990년 정부 보급품종 선정과 우리 무궁화에 대한 ‘단심계 홑꽃 무궁화’로의 기본적 합의, 그리고 관련 기연구물 검토 등을 통해 방안 마련이 가능하다고 판단하였다. 본 연구는 국가상징 국화에 대한 연구의 일환으로서 법률안 제정의 당위성을 정립하고, 나아가 그 방안을 모색해 국화 무궁화 선양에 기여할 수 있을 것으로 기대된다.

영문 초록

The aim of this study is to examine the need of legislative bill on national flower and to examine issues on the legislation bill enactment. There were total 9 proposals on the legislations bills on national flower from the 16th to 19th parliamentary term (6 individual bills and 3 national anthem integration bills). However, discussion on the issue was not made properly, and those were automatically annulled at the expiry of the term of the parliament. To examine the need of legislation bill on national flower, the study proposed 12 things with special reference to: reason of proposal of legislation bill and expert review opinion, opinion of government on legislation, opinion on people and private organization, preparation on the national symbol integration after unification And, it was found that there were two repetitive issues in the discussion of legislative bills. Regarding them, on ① it is more suitable to make individual legislation on Mugunghwa instead of national symbol integration bill, and on ② the selection of basic type kind of Mugunghwa, selection of government distribution kind in 1990 and single flower Mugunghwa, and a plan through research were found to be possible This study is related to the study on national flower as the national symbol. It is expected that academic a pproaches would secure justification of legislation bill enactment and contribute to the legislation bill enactment by seeking plans.
