전자민주주의와 SNS 정치참여의 상관관계에 대한 고찰

국문 초록

지난 2011년 10월 26일 서울시장 보궐선거 당시, 김제동 씨가 선거를 독려하는 투표 인증샷을 자신의 트위터에 게시한 사실이 현행 공직선거법을 위반했는지 여부가 논란이 되었다. 이 사실에 대한 시민의 검찰고발로 인해 SNS(Social Network Service) 를 통한 국민의 정치적 표현의 자유에 대해 고민을 할 수 있는 계기가 된 것이 사실이 나, 시대의 흐름에 역행(逆行)하고 민주주의의 꽃이라고 불리는 표현의 자유를 무시한 행태(行態)가 아닌가 생각된다. 물론 이 사건 이전에도 1997년 15대 대선 당시, 사이버 대선후보토론회에 대한 규제를 시작으로 이메일, 온라인 커뮤니티, 단문메시지 (Short Message Service, SMS), 블로그(Blog), UCC(User Created Contents), 트위터 등에 이르기까지 국민의 온라인에서의 정치참여가 제한되어 온 것이 사실이다. 그러나 헌법재판소 최근 결정에서는 정보통신망을 이용하여 인터넷 홈페이지 또는그 게시판ㆍ대화방 등에 글이나 동영상 등 정보를 게시하거나 전자우편을 전송하는 방법이 포함되는 것으로 해석하여 이를 금지하고 처벌하는 것은 과잉금지원칙에 위배하여 청구인들의 선거운동의 자유 내지 정치적 표현의 자유를 침해한다고 봄으로써 기존의 결정과 반대되는 판단을 했다. 이는 국민들이 자신의 정치적 의사표시를 자유롭게 함으로써 정치에 더욱 관심을 갖게 하고 정치참여를 보다 수월하게 이끄는 전환점이 되는 고무적(鼓舞的)인 현상이라고 할 수 있다. 더 나아가 헌법상, 진정한 민주주의를 실현하는 모습이기도 하다. 이에 본 연구에서는 이번 4.11 총선에서의 SNS 정치참여에 대해 검토하는 것과 동시에 앞서 살펴본 헌법재판소의 최근 결정이 우리에게 시사하는 바를 파악함으로써 SNS에서의 국민의 정치참여와 전자민주주의와의 상관관계를 고찰하고, 이를 바탕으로 SNS에서 정치참여의 개선방향을 모색해봄으로써 향후 12.19 대선에 있어서 국민의 정치참여를 도모하여 대의제실현과 동시에 국민이 중심이 되는 진정한 의미의 민주주의를 이루는 것에 초점을 맞춰서 연구를 진행한다.

영문 초록

At the time of the last Seoul mayoral election on 26th of October,2011, It became controversial whether Mr. Kim’s behavior of posting his photograph on Twitter to encourage voting violated the Public Official Election or not. Due to accusations of the citizens, It is true that It made people think about the Freedom of Political Participation through SNS more seriously ,but it is also believed that It went against the flow of the time and ignored the right to Freedom of Expression called The Flower of Democracy. Prior to this issue, during the 15th election in 1997 , It is undeniable that the Online Political Participation through E-mail, online community , SMS, Blog and UCC has been limited since the debate of presidential candidates on cyberspace was restricted. According to the latest verdict of the Constitutional Court, It is considered as the infringement of the Freedom of Expression and the violation of the principle of excess prohibition when prohibiting and punishing people for sending e-mails by using Information Network System(INS) and sharing their writing and video on internet websites, bulletin boards, and chatting rooms. By making people declare their political intention freely, It will begin to pay attention to the politics and It is encouraging phenomenon that It will be turning point to lead the political participation much more easily. One step further, In view of Constitution, It is a picture of realizing true democracy. In this way, we should take correlation with the Political Participation and E-Democracy on SNS into consideration by understanding what the recent decision of the Constitutional Court suggested. Based on this, I plan to make a study by focusing on the true meaning of democracy for the 12.19 next presidential election and seek improvement for political participation as well as promoting the realization of representative system.
