국문 초록

15년 11월 프랑스 파리에서 발생한 동시다발적 테러는 전 세계를 충격에 몰아넣었다. 테러는 강력범죄의 한 유형이지만, 오늘날 국제적 대형 테러는 국지적 전쟁이기도 하다. 2001년 미국의 9ㆍ11테러 이후에 테러에 대응하는 각국의 태도는 바뀌었다. 각국은 테러의 발생을 방지하기 위하여 관련법을 정비하고 국제공조를 강화하였다. 당시 우리나라도 테러방지를 위한 법률의 제정에 노력을 경주하였지만, 테러방지권한을 행사할 국가기관을 놓고 여야가 대립하였고, 일부 시민단체에서는 국민의 사생활의 비밀과 자유 등 기본권을 침해할 수 있다고 주장하여 법안이 무산되었다. 우리나라에서는 그동안 국제사회에서 대형 테러가 발생할 때마다 테러방지법의 필요성이 제기되었다. 더구나 해외에서 우리 국민이 테러로 인하여 희생이 될 때마다 국가차원의 대테러대책이 논의되었다. 테러가 발생할 때마다 여론은 테러방지를 위한 정부의 미온적인 대책이나 노력에 대하여 비판을 하였다. 그럼에도 그동안 국내에서는 북한의 도발 이외에는 이렇다 할 테러가 발생하지 않아서 테러에 대하여 그 심각성을 지적만 할 뿐이었다. 그런데 최근 이슬람 과격단체인 IS에 의한 테러가 지속적으로 발생하고, 테러대상국가로 우리나라도 거론되면서 국회차원 에서 다시 테러방지법에 관한 논의가 시작되었다. 파리에서 대형 테러사건이 발생하자 정부는 여러 대책을 내놓고 있다. 정부는 테러를 예방하기 위한 사전조치로 우선 국내에 입국한 테러단체 가입자의 신병을 확보하여 출국조치 하였고, 테러방지법의 제정을 위하여 노력하였다. 그 결과 2016년 3월 테러방지법이 제정되었다. 그렇지만 현행 테러방지법에도 여러 문제가 있다. 테러방지법은 그 실효성을 위하여 긴급한 상황에서 보다 신속하게 대응할 수 있도록 개정되어야 한다.

영문 초록

The simultaneous terrorist attacks in Paris which happened on November 2015 brought the whole world to shock. Terrorism is a form of violent crime, international terrorism nowadays is a local war. After the 9.11 attack, countries attitudes toward terrorism have changed. Each country has strengthened international cooperation and related laws to prevent terrorism. Korea pursued a bill for Anti-Terrorism Act, but the National Assembly could not agree on the authorities to exercise the right to prevent terrorism, and some civic groups claimed that the Act could infringe on fundamental rights such as privacy, which all led to a failure to pass the bill. In Korea, the need for an Anti-Terrorism Act was raised every time a large scale terrorism occurred in the international community. Moreover, every time Korean people were sacrificed by terrorism, countermeasures against terrorism were discussed at the national level, and the public criticized the government s lukewarm countermeasures and efforts to prevent terrorism. Nevertheless, Korea has never gone through major terrorist attack so far, while going through the provocations from North Korea, which explains the lack of concrete policy input into this issue. However, amongst the mounting terrorist attack in the international community, ISIS declared Korea as one of the target countries, and this brought back discussions on the Anti-Terrorism Act in the National Assembly. The government has launched several measures since the Paris attack. As a precautionary measure to prevent terrorism, the government secured the list of terrorist group affiliates and expelled them out of the country. It worked on the legislation as well. As a result, the Anti-Terrorism Act was enacted in March 2016. However, there are various problems in the current law. The Anti-Terrorism Act should be amended to respond more quickly in an emergency to its effectiveness.
