EU의 지식재산권 제도에 관한 고찰

국문 초록

유럽연합은 28개 가입국으로 구성되었고 세계 최고의 경제규모를 가진 국가연합이며, 유럽연합과 우리나라 양국 간 교역규모는 꾸준히 성장 하여 2015년에 연간 900억 유로(약 113조 2000억 원)에 달하게 되었 다. 그리고 로마법에서 유래된 대륙법체계인 유럽의 법제도는 우리나라의 법제에 상당한 영향을 끼치고 있다. 오늘날의 국제경제상황 하에서 지식재산권은 점점 국제화되고 국가 간 경계를 넘어 확대되고 있으며, 국가 간의 영역을 넘어 국제적ㆍ보편적으로 이용되고 있으며, 지식재산권침해에 대하여 일관되게 준거법을 적용하는 것이 핵심이라 할 것이다. 우리나라 헌법 제23조는 재산권보장을 선언하면서, 헌법 제22조 제2항에 학문과 예술의 자유 그리고 헌법상 문화국가원리의 실효성 확보를 위해 저작자ㆍ발명가ㆍ과학기술자ㆍ예술가 등의 권리보호를 규정하고 있다. 이처럼 지식재산권이 헌법상 기본권으로서 마땅히 보호되어야할 권리로 인정되는 이유는 지식재산권자의 발명·창작물에 대한 상당한 보상을 통하여 산업과 문화발전을 도모하기 위함이다. 유럽연합은 지식재산권 분야의 이론적이고 실용적인 측면 모두에서 큰 발전을 보이고 있으며 이에 대한 검토는 우리나라의 지식재산권 제도발전에 큰 도움이 될 것이 다. 따라서 한-EU 교역확대를 건전한 성장의 동력으로 활용하기 위해서는 유럽연합의 지식재산권 제도를 충분히 검토하고, 대한민국과 유럽연합 간에 체결한 FTA협정 내용을 분석하여 정책적 시사점을 얻을 필요가 있다.

영문 초록

The European Union comprises 28 member states and has the world s largest economic scale. Bilateral trade between the European Union and Korea has constantly grown and reached a record level of over 90 billion euros (about 113 trillion won)in 2015. The European legal system with the law of continental europe, which is directly traceable to the Roman law, has a considerable influence on the legal system in Korea. In today s world economic situation, intellectual property rights are becoming more internationalized and expanding over nation border, and it is a key to apply the lex loci protections to the infringement of an intellectual property right with a uniform approach. The right of property of all citizens shall be guaranteed by Article 23 and the rights of authors, inventors, scientists, engineers and artists shall be protected to ensure the principle of cultural state by Article 22(2) of the Korean Constitution. The reason that the intellectual property right shall be protected by the fundamental right in the Constitution is contribute to industrial development and the improvement and development of culture by substantial compensation for invention and creative works which intellectual property owner has created. The European Union has marked a breakthrough in case both theoretical and practical aspects of intellectual property rights fields and it will be very helpful for development of Korean intellectual property system to review the European intellectual property system. Therefore, it is necessary to examine European intellectual property system and to analyze the problems and suggestions of the Korea-EU FTA in order to make Korea-EU trade increase as growth power and finally to provide policy implications on the current intellectual property system in Korea
