국문 초록

1948년헌법 이후 한국은 의회민주주의에 관하여 많은 경험을 하였다. 의회민주주의 자체에 관한 한, 한국의 헌정사는 실패의 경험을 많이 가지고 있다. 그러나 전체적으로 보아 한국의 역사는 결코 실패의 역사가 아니다. 의회민주주의보다 각 시대마다의 국가과제가 우선하였던 것이다. 그래서 한국 역사의 단계마다 국회의 역할은 의도하였든 의도하지 않았든 간에 각기 달리 규정되었다. 하지만 오늘날에는 민주적 대표성을 보다 충실하게 구현할 수 있는 국회가 요구되고 있다. 지금까지의 헌정사 경험을 통하여 알 수 있는 사실은, 국회의 권한 확대보다 국회의 독자적인 권력 을 확보하는 것이 더 중요하다는 점이다. 국회는 특히 대통령으로부터 독자성(자율성)을 획득하여야 한다. 이를 위해서는 집권당, 그리고 국회의장의 역할이 중요하다. 또한 국회의 독자성 못지않게 중요한 것은 국회 권위 의 회복이다. 국민의 신뢰를 회복하기 위해 무엇이 필요한지를 국회는 객관적으로 파악하여야 한다. 이를 위해 외부 전문가를 중심으로 한 국회개혁자문기구를 의장의 직속 하에 설치하여 정확한 진단과 실효적인 처방을 구하여야 할 것이다. 의회민주주의의 발전과 관련하여 헌법질서의 구축은 대단히 중요하다. 이와 관련하여 형식적 의미의 헌법 개정 못지않게 실질적 의미의 헌법 개정이 중요함을 명심하여야 할 것이다. 무엇보다 어느 정부형태를 취하더라도 안정적으로 작동할 수 있는 정치적 인프라의 구축, 즉 정치제도의 정비가 더 시급하다고 하겠다. 정당의 민주적 운영과 지속성을 가능케 하는 정당제도, 민의의 비례적 반영을 가능케 하는 선거제도 그리고 민주적 대표성을 최대로 구현할 수 있는 국회제도가 바로 그것이다. 한편, 헌법개정을 통한 헌법질서의 구축과 관련하여, 무엇보다 대통령선거와 국회의원선거의 선거주기를 혼합주기로 조정하는 것이 시급하다. 또한 정부형태의 변경과 관련하여서는, 그 변화의 정도와 폭을 고려할 때 변화에 따른 전체적인 비용을 고민하여야 할 것이다. 개헌 이후에 큰 비용 없이 작동할 수 있는 권력구조로의 변경은 언제든지 시도할 수 있다. 그러나 충분한 경험이 축적되지 않은 권력구조로 가기 위해서는 좀 더 시간을 두고 추진하여야 할 것이다. 개헌 자체보다 더 중요한 것은 개헌 이후 체제의 안정성이기 때문이다.

영문 초록

Since the Constitution of 1948, Republic of Korea(hereafter, Korea ) has had a lot of experiences with parliamentary democracy. As far as the parliamentary democracy itself, she has experienced many failures. However, the history of Korea, as a whole, is by no means the story of failure. Each stage of her history had an urgent national task(Staatsaufgabe) more important than parliamentary democracy itself. Consequently, the roles of the National Assembly were different for each stage of Korean history, intentionally or unintentionally. However, nowadays, the National Assembly is asked to implement democratic representation more faithfully. What we know from the experience in the constitutional history is that it is more important to ensure the autonomous power of the National Assembly than to reinforce its competence. The National Assembly must enjoy the autonomy especially from the President, for which the ruling party and the Speaker of the National Assembly have some political spaces to perform their own roles. Also what is no less important is the restoration of the authority of the National Assembly. It must grasp objectively what is needed to restore public trust. For example, an advisory body consisting of many external experts should be set up in order that it can report directly an accurate diagnosis and an effective prescription to the Speaker. For the development of parliamentary democracy, it is very important to make the constitutional order in formal and substantial meaning. More than anything else, it is urgent to construct the political infrastructure that can work well with any forms of government: political party system that makes possible the democratic operation and sustainability of the political parties; electoral system that reflects public opinion proportionally. Concerning the constitutional amendment, it is necessary to adjust the electoral cycles of the presidential election and of the parliamentary election. More desirable would be a mixed cycle of concurrent/non- concurrent elections. Considering the cost and aftermath of change, it would be preferable to change the current government form into a more familiar one.
