중국의 「국내신용장 결제방법」에 관한 총론적 연구

국문 초록

우리나라의 최대 교역국이면서 다수의 한국기업이 진출하여 있는 중국은, 1990년대 중국내 기업 간 거래 결제방식이 환어음 같은 전통적 방식으로 해결이 용이하지 않자 중국국내 거래의 결제안정화를 위해 1997년 중국「국내신용장 결제방법」을 제정하였다. 그러나, 본 법률의 적용을 받는 국내 신용장 결제 방식을 이용한 기업간 거래 수 및 결제액이 급속히 확대되어 있음에도 불구하고, 본 법률과 관련한 학계의 연구는 찾아 볼 수 없다. 이에 본 논문은 중국의「국내신용장 결제방법」에 대한 심도 있는 연구를 통해, 중국 진출 한국 기업의 중국내 거래의 원활화 및 안정성을 제고하고 후속적 연구 담론을 고취함을 목적으로 한다.

영문 초록

Purpose : This article aims at analysing Chinese national rule for Chinese local documentary credit transactions, 'China Measures for Settlement by Domestic Letter of Credit 1997', to provide practical and legal implications for Korean enterprises. Research design, data, methodology : This article utilsed the literature reviews as the research methodology. Results : It is found that the Chinese rule for Chinese local L/C, which is not, albeit its importance, has not studied fully, contains domestic-oriented rules, such as the prohibition of utilisation of a transferable credit and so on. As these local-oriented rules are not conformed with international L/C practice, necessary acknowledgement thereof must be realised. Conclusions : Considering the fact that local L/C is widely used in China, it is suggested that local-oriented rules must be understood by the practitioners and further in-depth analysis needs to be performed.
