영문 초록

The problem of the infringement of personal information, first to induce a proprietary damage. Following this is be able to occur civil liability and criminal, legal responsibility. In this regard, the damage prevention due to leakage of personal information is an important policy issue. Flows out of these personal information is intended to infringe on the right to self-determination of virtually personal information. This induces the material and mental damage. Ultimately refers place great damage spread leading to crime. A complex society of such modern, to the application of the provisions, such as processing limitations of the ersonal Information Protection Act at the time of personal information infringement, it is necessary to spread the prevention of damage. So it is desired to provide an effective measure to minimize damage. The Legal benefits of the Personal Information Protection Act is trying to protect is the right of self-determination of the information. It is generated from the privacy provisions of the Constitution Article 17. This has the right to information subject to determine themselves about the use and disclosure of personal information. For more than three times violations must be introduced punitive damages System. So it appears that there is a need to actively cope with relapse prevention. On the other hand, specialized agencies prescribed by the Ministry of Government Administration and Home Affairs Minister or Presidential Decree shall take a scheme that can support the technology for such diffusion prevention, damage recovery of damage.
