영문 초록

Criminal Mediation is defined as a process in which the victim and offender reach a voluntary agreement through the third person about the harm caused by crime and future action-plan. These Criminal Mediations are derived from the Victim-Offender Mediation (VOM) in North America. In Korea, the Criminal Mediation has been defined in Crime Victim Protection Act and enforced since 2010. These Criminal Mediations must designed and enforced base on Restorative Community Justice ideology which can substantially restore victim’s damage. However, there are many problems to estimate the Korean Criminal Medication realize the Restorative Community Justice ideology. This thesis is to find problems of the current Criminal Medication from a Restorative Community Justice point, and base on these problems, in this thesis suggests a improvement plan of Criminal Medication which does based on restorative justice ideology.
