국문 초록

이 연구의 목적은 6호 처분을 위탁하는 새로운 위탁시설의 모델을 구축하기 위한 기초연구로서 한국의 6호 처분 위탁시설의 운영현황과 특성, 그리고 문제점을 파악하여 개선방안을 제안하는 것이다. 위탁시설의 운영특성을 인력체계, 전달체계, 관리체계, 지역자원연계, 교육프로그램 등으로 구분하여 분석하였다. 그 결과, 위탁시설은 몇 가지의 문제점을 가지고 있다. 첫째, 아동복지법상의 인력규정을 따르다 보니 전문인력이 부족하였고, 둘째, 재정적 어려움을 겪고 있었으며, 셋째, 대규모의 보호소년을 보호하고 있어 이탈과 탈주의 문제가 제기되고 있다. 넷째, 위탁시설에서는 가족과 사회, 학교관계를 회복할 수 있는 별도의 프로그램은 갖추지 못하고 있다. 이를 위한 개선방안을 제안하면 다음과 같다. 첫째, 인력조직의 효율화를 위해서 아동복지법의 개정을 해야 하고, 둘째, 재정지원을 위해서는 전달체계에 의존하지 말고 협동조합방식의 소규모 위탁시설을 구축할 것과, 셋째, 관리체계의 효율성과 지역자원연계를 위해서 폐쇄적인 시설을 지양하고 개방시설로 전환할 것, 넷째, 6호 처분의 특수성을 고려하여 회복에 초점을 맞춘 프로그램의 도입이 필요함을 제안한다.

영문 초록

As a basic study to establish the model of new commissioned institutions for juvenile offenders with the level6 correctional treatment, the objective of this study is to suggest the improvement measures by understanding the current operational status, characteristics, and problems of the level6 correctional treatment commissioned institutions in Korea. The operational characteristics of commissioned institutions were analyzed after dividing them into organizational operation, transmission system, management system, local resource connection, and educational program. In the results, the commissioned institutions had several problems. First, it was lacking in professional manpower as following the manpower regulations of the Child Welfare Act. Second, it was experiencing financial difficulties. Third, there was a problem of breakaway and escape as a large-scale juvenile offenders were protected. Fourth, the commissioned institutions did not have additional programs to recover relations with family, society, and school. The improvement measures can be suggested like below. First, the amendment of the Child Welfare Act was suggested for the efficiency of manpower organization. Second, the establishment of small-scale commissioned institutions based on cooperative association was suggested, instead of depending on the transmission system for the financial support. Third, the change from the closed institutions to open institutions was suggested for the efficiency of management system and the local resource connection. Fourth, the introduction of programs focusing on the recovery was suggested, by considering the specialty of the level6 correctional treatment.
