국문 초록

‘범죄의 원인을 어디에서 찾는냐’는 ‘그래서 범죄자를 어떻게 처리하느냐’에 결정적인 영향을 미친다. 그러므로 왜 범죄가 발생하는지 그 원인에 대한 인식의 차이에 따라범죄자에 대한형사정책에 대한 태도가 달라진다고볼 수 있다. 각나라의사회 제도나 정책들은 그 나라의 정치적 행태, 경제적 발전정도, 사회ㆍ문화적 배경뿐만아니라 이에대한 국민 의식에 의해형성되는 산물이라고할 수 있다. 이러한 문화적배경과 의식의 바탕위에서 개인의 가치관이 발달되며, 이것은 사회가 변화함에 따라 구성원들의 이념, 태도 등에 영향을 미친다. 이 연구에서는 범죄 원인에 대한 인식의 차이와 관련하여 영향을 미치는 기초적인 인구사회학적 요인으로 성별, 즉 여성의 정치적 이념에 주목하고자 한다. 세계적으로 여성은 과거에 비해 사회적ㆍ경제적으로 지위가 변화하고 범죄예방 정책에 대 한 참여 수준이 높아지고 있다. 연구결과, 남녀모두 억제론을 가장 많이 선호하였는데, 특히 처벌이 신속하고 엄격하지 못하기 때문에 범죄가 발생한다는 주장에 대해 매우 높게 지지하는 것으로 나타났다. 반면, 심리학적인 발달론에 대해서는 그렇지 않았다. 남성은 보수적인 사 람이 억제론을 지지한 반면, 여성은 진보적인 사람이 억제론을 더 지지하는 것으로 나타났다. 이러한 태도는 선행연구들과는 상반되는 결과인데, 여성들의 강력한 처벌의지의 변화는최근 급증하는 강력범죄와 아동ㆍ청소년및 여성을대상으로 하는 성 범죄의 증가와 관련된 것으로 볼 수있다. 법률 개정을 통한 법정형 상향에도 불구하고 여전히 낮은 실형선고율과 솜방망이식 처벌에대한 불만이 여성들의 범죄에 대한두려움을 증가시킨 것으로 이해될 수 있다. 이것은 여전히 사회적 취약자인 여성이 보호받지 못하고 있는 사실을 보여주고 있는 것이다. 법령의 정비를 통한 강한 처벌은 미봉책에 불과하다. 우리사회가 좀 더 안전하고윤택한 삶을 지속적으로 영위하기 위해서는 사회적 취약자들에 대한 배려와 범죄 예방 및 범죄자들의 사회복귀에 대한 관심이 필요하다.

영문 초록

"Where is the cause of crime" exercises a decisive influence on "how to deal with the criminal." The way people look at the criminal policy for the criminal can be said to depend on the way they look at the cause of the crime. Each country's social system and policies could be regarded as the products of not only its political practices, economic development and sociocultural background but of national consciousness. Such a cultural background and consciousness are the foundation on which individual people's values are built, and affect their ideology and attitude in line with social changes as well. The purpose of this study was to examine differences in awareness of the causes of crime. It's specifically meant to focus on the influence of gender, one of basic influential sociodemographic factors, especially women's political opinions. Women's socioeconomic status becomes higher than in the past, and they are increasingly involved in crime prevention policy setting. The findings of the study were as follows: Both of the men and women who were investigated had the highest preference for deterrence theory. In particular, they gave a quite strong support to a claim that a crime takes place due to lack of prompt and severe punishment. On the contrary, that was not the case for psychological development theory. The conservative men backed up deterrence theory, whereas the progressive women gave more support to that. This finding runs counter to the findings of earlier studies. Women asked for strong punishment, and their change seemed to have something to do with a rapid increase in violent crimes and another increase in sexual crimes against children adolescents and women. Although the level of statutory punishment becomes stronger in the revised law, the rate of imprisonment sentence is still low, and the women seemed to have more fear for crime because of their complaints about soft punishments. And it seems to show the fact that women who are socially disadvantaged aren't protected properly. Strong punishment in the law is a mere stopgap. In order for people to lead a more safe and affluent life in our society, more considerations for the socially disadvantaged, intensive efforts for crime prevention and more concern for the reentry of criminals into society are all required.
