국문 초록

본 연구는 D규칙의 개념과 효용성을 규명하고, 실무적용상의 유의점을 제시하는데 그 목적이 있다. 이러한 목적을 달성하기 위해 본 연구는 DAT, DAP, DDP규칙에 관한 자료를 활용하였고, 인코텀즈 2010에서의 통관 및 보안, 운송계약, 인도 및 인수, 위험이전, 그리고 비용배 분의 다섯 가지 분야에 초점을 맞추었다. 본 연구에서 D규칙은 매도인이 물류시스템 전 과정을 관리하고 통제하는데 적합한 거래 규칙임을 제안하였다. 그리고 다섯 가지 분야에 있어서는, 통관 및 보안과 관련해서 매매당사자들은 보안관련 조치를 숙지하여야 한다. 운송계약은 매도인에 의해 체결되므로 운송비는 매도인의 부담이다. 인도 및 인수 조항은 매도인의 물품인도에 매수인은 물품수취 할 의무가 있다. 위험이전에서는 위험 분기점 및 위험시기와 조기위험 이전에 관한 내용을 이해 하여야 한다. 비용배분에서는 매도인은 인도지점에 물품이 도착하기까지 필요한 비용을 지급하고, 매수인은 그 이후의 추가비용을 지급하여야 한다. 따라서 매매계약 당사자는 이상과 같은 유의점을 명확하게 이해하여 실무상 오해와 분쟁을 사전에 방지하도록 노력을 기울여야 하고, D규칙은 운송수단의 발달, 서비스의 연장, FTA에 의한 관세장벽의 철폐 등으로 인해 활용의 극대화가 필요하다.

영문 초록

Purpose : The purpose of this study is to provide the practical implications of attention point and utilizing on the D-rules of Incoterms？？ 2010. Research design, data, methodology : This study is analyze the five parts of the customs clearance and security information, contract of carriage, delivery and taking delivery, risk transfer and allocation of costs from D-rules. The analitic data are DAT, DAP, DDP and analyzed published literature in Incoterms？？ 2010. Results : According to the results from this research, D-rules appropriate to control and management in the all process of logistics system of seller. In the side of five parts, seller and buyers must comprehension any security-related information for import and export. Contract of carriage provide the parties of having the obligation to make the contract of carriage and to bear costs necessary for the contract of carriage. Delivery and taking delivery must known the article A4 and B4. Risk transfer must understanding the Incoterms？？ 2010 rules. Allocation of costs must according to A6 and B6, the seller must pay all costs relating with A4, and the buyer must pay all costs except. Conclusions : This paper suggests that seller and buyer for the parties of trade contract will make an effort to prevent the misconception and dispute with surely understanding above attention point and utilities of D rules. D-rules necessity the maximization of practical use because of tariff barriers abolition of FTA, expansion of transport service and development of transport mode.
