국문 초록

최근 ICC와 SWIFT 의 협조로 전자통신 교환에 따른 무역대금결제가 TSU/BPO방식에 의해서 진행되고 있었으나 이에 대한 거래기본규칙인 URBPO가 제정되어 시행되게 되었다. 그간 이에 대한 국내외에서 많은 연구가 진행되고 있었으나 대부분 URBPO의 내용 및 그 시행제도에 대한 연구고찰이 많았다. 이에 따라서 본 논문에서는 URBPO에 따른 거래절차와 시행상의 문제점 및 그 시사점에 대해서 실무적 관점에서 검토해보기로 하였다. 과거의 서류거래에서 벗어나 거래의 중요정보를 상호 교환함으로서 은행간 지급 결제가 확인되면 매도인 거래은행에서 수출자에게 open account 방식에 의해 다양한 금융지원을 해주는 방식으로 매도인, 매수인 및 거래은행 모두가 서류 거래에 따른 비용과 노력에서 해방되어 신속하고 효율적인 금융 지원을 활용할 수 있는 획기적인 제도로 보여진다. 본 논문에서는 URBPO에 근거한 주요내용 및 그 역할 및 실무상 유의사항에 대해서 검토해 보기로 한다.

영문 초록

Purpose : In2013 by cooperation between I.C.C. and SWIFT, Uniform Rules of Bank payment obligation(URBPO) was legislated, which would be dedicated to the vitality of settlement against world trade transaction. This paper introduces the Uniform Rules of Bank Payment Obligation (URBPO 2013 I.C.C) and studied processing and the special attention of it’s Rule in the practical trade transaction. Research, design, data, mythology : This paper review and analyzes URBPO 2013 I.C.C. and UCP600, eUCP version 1.1. also it surveyed the internal literature about URBPO and many foreign reaches, which was introduced in DC Insight from 2012~to 2015. Results : According to analysis, many unsolved problem was founded to force it’s rule in practical trade transaction. for example, authority reference, governing Law, Information data investigation etc. Conclusion : This rule originally legislated for the large cooperation in advanced countries, but to force it for small cooperations in underdeveloped countries, many steps to be solved was found. But, the BPO is likely to enable new business opportunities, lower costs and strenghen key customer relationships.
