국문 초록

혼인유대와 관련하여 교회는 하나의 딜레마를 직면하고 있다. 한편에서 교회는 창조주의 계획에 따라 모든 혼인유대는 해소될 수 없다는 '혼인의 불가해소성' 교리를 수호하며 강조해야 하고, 다른 한편에선 교회 자신의 사목적 소명에 따라 혼인의 불가해소성을 깨뜨림으로 해서 신앙생활을 충만히 수행하고 있지 못하는 사람들의 어려운 상황을 도와주어야 한다. 이 두 측면은 서로 상반되는 방향으로 전개되는 듯 보이나, 이 모든 교회의 노력들은 그것이 혼인유대의 불가해소성 강조이든 아니면 혼인유대의 해소이든, 바로 ‘영혼의 구원’이라는 교회법적 최상의 목적을 수행한다는 공통점을 지니고 있다. 즉, 혼인의 불가해소성은 혼인 자체를 견고케 하고 가정을 보호하기 위한 최소한의 원칙이기에, 이에 대한 강조는 바로 보편적인 차원에서 영혼의 구원을 지향하고 있다. 그러나 현실에서는 그에 반하는 상황을 겪게 되는 사람들도 적지 않게 나타난다. 그런 사람들은 교회 안에서 정상적인 성사생활을 하지 못하는 경우가 생기게 되는데, 교회는 적절한 방법들을 동원해서 이런 어려운 상황에 놓여있는 사람들을 도와주어야 할 필요성이 있다. 교회의 이러한 긴급한 사목적인 배려는 이미 파기된 혼인에 대한 무효의 판결, 바오로 특전과 베드로 특전 등 신앙의 특전을 통한 혼인유대의 해소 그리고 내적 법정을 통한 해결 등으로 나타난다. 이 모든 사목적 배려는 영혼의 구원을 위해서 당사자들을 ‘혼인의 불가해소성 법'에서 풀어주고 덮어주거나 무효화시킴으로써 나타나는 것이다. 바로 혼인유대와 관련한 교회의 딜레마 중심에는 혼인의 불가해소성이라는 혼인의 본질적 특성이 자리 잡고 있다. 교회가 자신의 사목적 소명을 제대로 수행하기 위해서는, 혼인의 불가해소성이란 무엇이며 어떤 경우에 해소 가능한지 또 그 해소는 어떻게 누구에 의해서 실행될 수 있는지 그리고 현실적인 적용에 있어서의 한계는 무엇인지 등에 대한 이해가 필요하다. 이는 바로 혼인유대의 해소에 대한 교회의 권한을 이해하는 것이다. 그 지점이 바로 교회로 하여금 혼인유대 해소와 관련한 사목적 배려를 보다 적극적으로 전개할 수 있도록 하는 출발점이 된다. 본 소고는 이러한 목적으로 혼인유대 해소에 관련한 교회의 권한에 대해서 정리하였고, 베드로 특전이라 불리는 신앙의 특전을 적용함에 있어서의 한계에 대해서도 살펴보았다. 또한 그 한계를 개선하고 보다 현실적인 적용을 위해서는 교황의 혼인유대 해소권을 개별교회의 주교들에게도 확대하는 방안을 제시해 보았다. 이를 통해서 혼인유대의 해소가 절실히 필요한 경우에 보다 적극적인 사목적 배려를 실시할 수 있도록 하기 위함이다.

영문 초록

The Church faces to dilemma regarding marriage bond. The Church protects and emphasizes ‘the Indissolubility of marriage’ according to God’s plan one side, and the other side the Church should help those who broke ‘the Indissolubility of marriage’ then cannot fulfill faithful lives because of the Church’s pastoral ministry. These two sides look like to be developed into the opposite directions each other, but there are common points; emphasizing ‘the Indissolubility of marriage’ or dissolving marriage bond, both are to fulfill the ultimate purpose of the Church Law -salvation of soul-. As ‘the Indissolubility of marriage’ strengthens marriage life itself, which is the minimum principle to protect the family, emphasizing this pursues the salvation of soul in universal dimension. But in real life, there are many people who suffer in opposite situations. Those people could not perform normal sacramental lives. The Church needs to help these people in difficulty with adequate ways. The Church’s urgent pastoral considerations are shown in invalidity verdict of broken marriage, dissolving marriage bond through faith privileges like Paul’s and Peter’s, and settlement in inner court. All these pastoral considerations are to untie to cover up or to nullify from ‘the Indissolubility of marriage law’ for their salvation of souls. In the center of the dilemma which is related to marriage bond lies in the original characteristic of marriage; ‘the Indissolubility of marriage’. To fulfill the Church’s pastoral ministry smoothly, it is needed to understand what ‘the Indissolubility of marriage’ is, in what situation this can be dissolved, by whom it can be performed, and what is the limitation to apply it practically. This is to understand the Church power for dissolving marriage bond. That is the starting point to spread out positively dissolving marriage bond in the Church’s pastoral considerations. This study consolidates the Church power regarding dissolving marriage bond, look into the limitation for applying Peter’s privilege. And propose to improve its limitation and to widen the power of dissolving marriage bond from Pope to bishops of individual church for practical application. This is to perform pastoral considerations more positively when they need strongly dissolving marriage bond.
