인권관점에서 본 민영교도소의 선행연구에 대한 비판적 검토

국문 초록

아시아에서 최초의 민영교도소라는 소망교도소가 아가페재단의 오랜 노력 끝에 2010년 12월에 경기도 여주에서 개소하였다. 그 결과 2015년 1월 현재 아가페 재단에 의해 운영되는 소망교도소는 철저히 관료주의적 문화에 의해 지배되어온 국영교도소보다도 훨씬 낮은 출소자의 재범률을 보여주고 있다. 또한 민영교도소인 소망교도소는 90%의 국고지원과 10%의 아가페의 자체 재원으로 운영되고 있다. 그 결과 민영교도소인 소망교도소는 재범률과 교정경비, 교정프로그램 등 다양한 측면에서 성공을 거두었으나 교정프로그램의 종교성 등 여러 측면에서 문제점들이 노정되어 왔고 이런 문제점들은 선행연구들에서 많이 제기된 것들이다. 그런데 민영교도소의 문제점에 관한 기존의 여러 선행연구들은 제한된 관점에서만 접근하여 교정복지적 측면이나 교정공공재 생산레짐측면, 이념적 측면 등에서는 간과한 측면이 있다. 따라서 본 논문에서는 기존의 선행연구들이 간과한 교정복지적 측면, 이념적 측면 등에서 민영교도소의 선행연구들에 대한 검토를 하고자 한다.

영문 초록

Somang prison which is called the first nonprofit and private prison in Asia and Korea opened on the first of December in 2010 in YeoJu city of kyunggi province through much efforts of the Agage Committee for the promoting a christian prison in korea. Now on January in 2015 year Somang prison which is operated by Agape committee shows much lower recidivisim rate (the second offence rate) than the state-operated national prisons which is thoroughly domminated by bureaucratic paradigm and culture which has continued for long year in correction for prisoner. Somang prison has been operated at a cost of 90percent national aid and 10percent self-aid by the Agape. As a result Somang prison shows diverse success in the second offense rate and operating cost and correctional program than the state-operated national prisons. Nevertheless, there are diverse problems in religious correctional programs and so on which the existing studies have pointed out about the private prison in korea since 2010. But, existing studies about the Somang prison and private prison in diverse points have approached in the limited view and neglected the new correctional social welfare view, the ideology, the private prison regime and so on. Therefore I would like to approach in the correctional social welfare view and so on which existing studies have passed over about the problem of private prison.
