조망권과 경관권의 보호요건과 손해배상기준에 관한 연구

국문 초록

도시건축물의 고층화, 밀집화되어 가면서 환경권의 하나인 조망권의 생활상 이익과 가치 침해로 인한 손해배상청구사건이 증가되고 있으며, 건축허가취소송을 하는 사례가 발생하고 있다. 한편 조망권과 구별되는 지방자치단체의 경관법에 의한 경관권의 법적 보호인정과 권리구제 강화가 요구되고 있다. 특히 일본에서는 조망권과 경관권을 구분하여 이해하고 있고, 조망권을 이해함에 있어서 개방감을 고려하지 않고 있는데 반하여, 우리나라에서는 천공조망권을 인정함에서 있어서 개방감이 중요한 기준이 되고 있을 뿐만 아니라 경관조망권보다는 천공조망권을 보다 적극적으로 인정하고 있는 경향이다. 조망권과 경관권의 법리를 우리나라와 일본의 입법례와 판례를 비교법적으로 고찰하여 경관조망권과 천공조망권의 법적보호요건을 비롯한 경관권의 법적 보호요건을 검토하고 조망권과 경관권의 침해에 따른 손해배상기준을 제언한다.

영문 초록

Especially in Japan, it has been understood by dividing the view and landscape rights, contrary to does not take into account the sense of openness in understanding the view, in our country, open feeling and the important criteria be recognize perforation view Not only it is ringing, there is a tendency that admits sky view more aggressively than landscape view. Review the doctrine of view and landscape rights Korea and Japan of legislation examples and legal protection requirements in comparison to legally consider the precedent landscape rights, including the legal protection of the requirements of the landscape view and the sky view I want to recommend damages criteria by infringement of view and landscape rights.
