미국 수사기관의 온라인 감시에 대한 비판적 연구

국문 초록

IT 기술의 비약적 발전에 힘입어 새로운 통신매체인 인터넷이 기존의 통신수단인 우편물이나 전화가 차지했던 영역을 일부 대체함에 따라, 범죄분야에 있어서도 인터넷이 그 수단으로 활발히 이용되고 있다. 이에 미국 수사기관은 새로운 범죄수단의 등장에 대처하고자 일정한 절차를 통해 네트워크 서비스 제공자로부터 특정 사용자의 계정정보를 취득하고 있고, 온라인상에서 용의자들을 직접 감시할 수 있는 다양한 프로그램들을 개발해 왔다. 9 ․ 11 테러 이후 국가안보나 사회안전망 확보를 위해 범죄 관련자들의 디지털 흔적을 수집․분석해야 한다는 필요성이 강력히 제기되면서, 미국 연방수사국(FBI)은 카니보어, 매직랜턴, CIPAV와 같은 스파이웨어 프로그램을 개발하여 이용해 온 것이다. 그러나 이러한 감시 장치를 활용한 온라인 수사기법에 대해서는 사생활 침해의 문제가 끊임없이 거론되고 있고, 국가안보라는 목적 하에 수사기관에 의한 광범위한 온라인 감시가 정당화 될 경우 빅브라더의 존재를 지각한 시민들의 표현의 자유가 상당히 위축될 수 있다는 우려도 제기된다. 최첨단 기술이 범죄의 수단으로 이용되고 있는 오늘날, 국가안보나 사회안전을 위협하는 범죄에 대응하기 위해서는 수사기관도 보다 강력한 감시 장치를 활용해야 한다는 필요성이 인정된다. 이에 본 논문에서는 국가안보와 시민의 자유라는 상충하는 이익 간의 균형점을 찾기 위해 치열하게 논의를 전개해 온 미국을 중심으로 수사기관의 감시 장치의 활용에 대한 종래 연방대법원의 입장을 살펴보고, 최근 논란이 되고 있는 온라인 감시 장치 이용에 관한 법적 쟁점 및 제도화 방안을 고찰하고자 한다.

영문 초록

The FBI has secret weapons such as carnivore, magic lantern and CIPAV in order to counter the war on cybercrime. The bureau used the spyware to intercept an e-mail bomb threat in 2007 by a high school student in Washington state. Spyware is generally defined as software that is surreptitiously installed on a user's computer and monitors a user's activity and reports back to a third party on that behavior. Spyware developed or used by law enforcement agents has been called fedware. A sophisticated fedware program has played a crucial behind-the-scenes role in federal investigations into extortion plots, terrorist threats and hacker attacks in cases stretching back. Although new technological devices greatly enhance the capability of law enforcement to collect intelligence data, if unchecked by rules, the government will be able to use these devices to intrude into virtually all aspects of our personal lives. September 11 reinforces national security as a paramount concern of the administration. For the first time, foreign terrorists were able to launch a large scale and audacious attack on American soil. The threat of terrorism makes Americans more receptive to the use of surveillance devices that would maximize the success of foreign intelligence gathering, even if such devices come at the price of infringement on civil liberties. However, the right to privacy is the primary civil liberties concern when analyzing surveillance devices. If citizens feel the government might be secretly monitoring their computers, they may be overly cautious about what they write in e-mails or even documents that are drafted but never sent to a recipient. The advance of technology requires law enforcement agencies to develop and implement more powerful surveillance devices to keep up with sophisticated terrorists and criminals. We should carefully balance the national security benefits such technology brings against the civil liberties problems it causes. This dissertation first inquires into court decisions on usage of surveillance devices by law enforcement agencies in the United States, and then examines legal Issues about online surveillance that has been controversial. Futhermore, this paper attempts to provide a direction to institutionalize online monitoring efforts by law enforcement officials.
