일본 탐정업법의 제정배경과 주요 내용 및 정책적 함의

국문 초록

본고는 민간조사제도의 도입과 관련하여 민간조사업법안이 국회에 계류 중인상태에서 이웃 일본이 2006년 6월에 탐정업법을 제정했기에 이 법률의 제정배경과 주요 내용들을 분석하여 우리 법안에 주는 시사점들을 밝히고자 한 연구이다. 연구결과를 종합해보면, 탐정업법의 제정배경은 한 마디로 탐정업과 탐정들의 불법행위를 규제하자는 차원이었다. 즉, 탐정업의 진흥이나 선진화라는 명분보다는 탐정업계의 고질적인 불법행위를 규제하려는 차원이 더 강하게 작용한 것으로 판단된다. 탐정업계나 탐정들에 의한 조사비용의 과다 청구와 조사의 부실로 사회적 파문이 일었기 때문이다. 특히, 동화지구와 부락차별사상에 따른 일본 사회의 집단 따돌림과 이에 정보를 제공한 탐정들의 불법행위에 대처하기 위해 탐정업을 제도권내로 끌어들여 규제할 필요가 있었기 때문이다. 탐정업법은 우리 법안 규모의 약 1/2에 달하는 법률로서 이 법에는 ① 신고제, ② 결격사유, ③ 법령 준수와 위법 목적 조사의 금지, ④ 비밀 준수 의무의 명확화, ⑤ 계약의 적정화와 중요 사항의 설명 의무, ⑥ 교육이나 감독의 규정, ⑦ 벌칙 등을 두고 있다. 이 법률의 큰 특징은 두 가지로 하나는 탐정업자의 불법행위에 대한 규제와 관리이고, 다른 하나는 탐정업무를 통한 개인의 권리이익 침해의 방지이다. 이 탐정업법이 우리의 민간조사업법안에 주는 시사점은 다음과 같다. 첫째, 일본에서는 탐정업에 대한 영업방식과 민간조사업협회 등은 업계의 자율에 맡기고 있기 때문에 법률에 근거조항이 없다. 특히, 우리 법안은 합동법인과 민간조사업협회 관련 조문들을 두고 있는데, 이 중 협회는 이익단체화 할 공산이 크므로 법안에 협회관련 조문을 두는 것은 재고해야 할 것이다. 둘째 탐정업법은 불법이나 편법을 , 동원하여 개인정보를 캐내는 탐정업자들을 규제함과 아울러 개개인의 개인정보를 보호하고자 하고 있으므로 우리 법안에서도 개인정보 보호의 강화라는 점을 선명하게 부각시킬 필요가 있다. 마지막으로, 탐정업법은 업무범위를 특정하지 않고 포괄적으로 규정하고 있고, 자격이나 자격기준에 대한 근거 조항이 없으며, 결격사유만 없으면 누구든지 자유롭게 탐정이 될 수 있게 하고 있다. 따라서 이에 대한 과도한 제한을 하고 있는 우리 법안에 많은 시사점을 주고 있다.

영문 초록

This research focuses on enactment backgrounds, main contents & policy implications of Japanese Private Detective Service Law. In modern society, there have been great demands for various private investigation services and personal informations collected by private investigator. Actually Korea National Assembly have prepared the law enactment of the private investigation service system since 2005 but we should still try to solve many problems for the legislation of private investigation service. We should learn many suggestions granting Japanese Private Detective Service Law to our bill. Enactment backgrounds of Japanese Private Detective Service Law can be summarized as follows : There are many serious illegal private investigation activities in Japan. So many accusations and complaints occur against these illegal activities but the police agency can hardly solve the problem lack of regulating law. Main contents of Japanese Private Detective Service Law can be summarized as follows : ① report to Public Safety Board, ② unqualified person, ③ observation of rules and prohibition of illegal investigation, ④ observation of secrecy, ⑤ appropriateness of contract and explanation of contractual main contents, ⑥ regulations of education and supervision, ⑦ penal regulations. So japanese police agency can solve illegal problems caused by private investigation firms and employee. Futhermore, japanese police agency can regulate private investigation firms and employee to protect personal information. Suggestions granting Japanese Private Detective Service Law to our bill can be summarized as follows : First, Regulations related to private investigation association should be eliminated because of risk to be profit-oriented party. Second, Japanese Private Detective Service Law have emphasis on keeping personal information. Lastly, In most states, the person who do investigative work, must be qualified by training and written examination but in Japan there is no restrictions to be private investigator. Qualification operations of two our bills are overstrict. Qualification regulations need to be mitigated. The reason is two greatly. One is that insufficient people can not survive in the competitive security world. Another is to open the door for youngsters to give an opportunity working in this field. Supervision of private investigation business place responsibility on the Chief of National Police Agency.
