민간조사원의 업무범위와 타 법률과의 관계에 관한 연구

국문 초록

국회에 제출되어 있는 민간조사업법안의 주요내용을 이루고 있는 민간조사원의 업무범위, 자격시험 및 감독관청 등에서 서로 이견(異見)을 보이고 있어 향후 법안 심의나 통과와 관련하여 공방이 예상된다. 더구나 민간조사업과 직ㆍ간접적인 관련이 있는 대한변호사협회는 이미 지난해 국회행자위에 제출한 의견서에서 변호사 등 직무의 침해와 이로 인한 갈등초래, 개인의 사생활 침해우려, 퇴직공무원들의 생계수단마련으로 전락할 가능성 등을 들어 '절대반대' 입장을 표명한 바 있다. 현재 발의된 민간조사업법안에는 민간조사원의 업무를 '범죄 및 위법행위와 관련된 조사' 등 지나치게 광범위하게 규정돼 있어 다른 법률과의 관계 및 수사기관의 업무와 충돌할 가능성을 내포하고 있고 사생활 침해 등 부작용을 예방하기 위한 제도적 장치가 미흡한 점 등도 문제로 지적되고 있다. 민간조사제도가 국민의 법률서비스의 질을 제고하는 데 기여하기 위해서는 민간조사업법의 도입과정에 업무의 내용과 범위, 민간조사원의 권한, 자격, 규제 등에 대한 면밀한 검토가 선행되어야 할 것이다. 특히 민간조사원의 업무범위는 민간조사제도 도입의 승패를 좌우할 정도로 중요한 문제인 만큼 진지한 검토와 국민적 공감대를 형성할 수 있도록 해야 할 것이며, 다른 법률과의 관계 등에 대하여도 면밀한 검토가 필요할 것으로 생각된다. 따라서 이 논문은 민간조사제도의 도입을 전제로 민간조사원의 업무내용과 범위를 어디까지로 한정할 것인지, 또 민간조사원의 업무범위 설정에 따른 다른 법률과의 관계를 검토하는데 중점을 두었다. 민간조사원의 업무범위의 적절한 설정을 위해서 미국, 일본 등 외국 민간조사원의 업무와 역할을 알아보고, 두 의원이 제출한 민간조사업법상의 업무범위를 비교 검토하였으며, 타 법률과의 관계는 민간조사업법과직ㆍ간접적으로 가장 관계가 많을 것으로 예상되는 변호사법, 신용정보의 이용 및 보호에 관한 법률, 공공기관의 정보공개에 관한 법률, 형법 등과의 관계에 있어 상호 충돌내지 개정되어야 할 조항들을 중심으로 검토하였다. 민간조사업의 업무범위에 있어서는 현재의 민간조사업의 업무범위는 포괄적인 규정을 나타내고 있어 법률시행의 원래 취지를 충실히 반영하지만 현행 법률과 충돌(변호사법 등)가능성은 안고 있다. 따라서 적절한 업무범위의 설정이 대단히 중요한 바 중범위 모델을 적용하는 것이 시작 초기에 혼란을 최소화하고 국민의 법률생활의 안정과 법률서비스의 질을 향상시킬수 있는 현실적인 대안이라고 생각한다.

영문 초록

Even with the recent growth of interest in private policing, very little has been written about the work of private investigators. This is surprising considering their relatively long history and undeniably high profile in popular culture. This article discusses their modern role in the context of four key issues : competence, legitimacy, relationship with the public police and future challenges in managing a diverse policing structure. It describes the services they most typically provide, identifies their principal client groups and reflects on how statutory might impact upon their policing and social control. The private security sector encompasses a wide variety of services, including the manufacture and installation of security hardware, static and transit guarding, security management and consultancies and private investigation services. Policing is composed of public policing and private policing. Private Investigation system is one of private policing system. In our country, We, Koreans are familiar with private security rather than definition of private policing. Also, our society have a cognition that private security and private policing have same meaning. But, private policing have a many sub-contents like as private security, private investigation, crime investigation, terrorism prevention etc in many foreign countries. The plans for development focused on the main subjects related to regulations among the private investigation bills are presented as follows. First, in terms of the work scope, the field related to personal duties should be permitted, and it should be expanded gradually to the field of common duties. Second, in terms of the qualifying testing for private investigator, excessive limitation on participants should be avoided, and reasonable limitation for eligibility is necessary. Third, by reinforcing the items regarding the cancellation of registration stated in the private investigation bill, super-vision should become strict. To mention other items to be taken into consideration, there are an introduction of a class system (or distinction system) by the work capacity on private investigation.
