건전한 집회시위문화 조성방안

국문 초록

헌법 제21조 제1항은 모든 국민에 대하여 집회의 자유를 인정하고 있다. 그런데 의사표현의 실효성을 증대시키고 직접민주주의의 수단으로서 평화롭고 적법하게 개최되어야 할 집회시위가 경찰의 자율적인 집회시위문화 정착 노력에도 불구하고 각 사회계층과 집단의 이익표출을 위한 민원성 집회시위의 증가에 따라 여전히 불법과 폭력이 사라지지 않고 있다(2003년 불법폭력시위 134회). 이에 이 연구에서는 헌법의 원리에 따라 합법적인 집회시위는 철저히 보장하고, 공동체에 피해를 주지 않는 범위 내에서 집회시위가 허용되어야 한다는 기본 인식을 전제로 현행 법규범 하에서 건전한 집회시위문화를 정착시킬 수 있는 방안을 다음과 같이 제시해 보았다. 첫째, 민주적인 집회시위문화의 조성과 준법의식의 배양을 위한 지속적인 교육이 필요하다. 둘째, 합법적인 집회시위는 철저히 보장하되 불법적인 폭력시위자에 대해서는 확실한 법집행과 법 집행의 일관성을 제고시킬 필요가 있다. 셋째, 정부에서 정책결정시 폭넓게 국민들이 참여할 수 있는 통로를 마련하여 사전에 분쟁을 조정할 수 있는 장치를 마련하고, 국회의원을 비롯한 사회지도층의 법률준수 의지와 솔선수범의 풍토를 진작시킬 필요가 있다. 넷째, 경찰의 부정적인 모습을 주로 보도하는 언론의 보도태도도 이제는 불법폭력시위에 대하여 공정하고 엄정하게 비판하는 태도로 전향적으로 바뀔 필요가 있다. 끝으로 선진시위문화 정착을 위해 국민과 경찰이 제 역할을 다 할 때 법과 원칙이 지켜지는 아름다운 사회가 조성될 것이다. 아울러 평화적인 집회시위문화의 정착을 위해서는 법적ㆍ제도적인 보완뿐만 아니라 사회구조적, 정치적, 경제적인 대응 또한 필요하다.

영문 초록

The first section of Korean Constitution Article 21 recognizes freedom of assembly for everybody in Korea. However, assembly and demonstration, supposedly enhancing effectiveness of expression of intention, being as a means of democracy, and being lawfully held, still remains unlawful and violent, despite autonomous efforts of police to settle autonomous efforts to settle the Culture of Sound Assembly and Demonstration down, along with the increase of assembly and demonstration which mainly comprises a civil appeal to vent interests of their group and each of all social standings (Unlawful Violent Demonstration 134th in 2003). Under a premise of thoroughly securing lawful demonstration based on the Constitutional principle and within the limits of permitting harmless assembly and demonstration to a communal society, this study, under the current related lawful regulations, is to suggest the following ways in order to root the Culture of Sound Assembly and Demonstration: First, sustained education will be needed to promote not only democratic culture of assembly and demonstration but also law-observance. Second, lawful assembly and demonstration should be secure but certain and consistent law enforcement should be raised against unlawful demonstrators. Third, the Korean government should establish a pathway for people to participate in public policy decisions and in advance install a device to mediate a potential dispute. Also, the climate of law-abiding willingness and initiative by the higher leading classes including the National Assembly should be promoted. Fourth, the mass media attitude of negatively reporting policing should be converted to that of being fair and severe against unlawful and/or violent demonstration. Last, for setting a developed culture of assembly and demonstration, people and police should fulfill their own duty to secure law and principle in society. In addition, not only lawful and systematic supplement but also social structural, political, and economic confront should be needed.
