실종자 업무처리와 수사의 현황 및 개선방안

국문 초록

현재 우리나라에서 미아 또는 가출인으로 경찰에 신고되는 실종자 수는 매년 6만4천여명에 이른다. 이것은 하루 평균 170여명의 사람이 없어지고 있다는 것을 뜻하는데, 결국 우리나라에서는 8분당 1명 꼴로 사람이 실종되는 셈이다. 우리 사회의 실종자 문제가 이처럼 심각함에도 불구하고 이에 대한 경찰의 업무 처리와 수사 시스템은 상당한 문제점을 노출하고 있다. 현재 실종자 문제에 대하여는 별다른 대안을 찾지 못하고 있는 형편이며, 이에 대한 기존의 학술적 연구와 논의 역시 거의 드물다고 할 수 있다. 이 연구에서는 실종자(미아ㆍ 가출인)에 대한 경찰의 업무 처리와 수사가 현재 어떻게 이루어지고 있는지를 살펴보고 그 문제점을 파악하여 바람직한 개선방안을 제시해보고자 하였다. 실종자 업무처리와 수사에 대한 개선방안으로는 ① 실종자 관련법의 제정 ② 실종자 업무처리ㆍ 수사 전담 기구의 설치와 전산수배 강화 ③ 관련 기관간 상호 연계 시스템 구축 ④ 보호시설 수용자 정보의 전산화와 관리ㆍ 감독 강화 ⑤ 가출인 등에 대한 DNA 데이터베이스의 구축 ⑥ 신원 불상 변사체에 대한 단독매장 의무화와 DNA 데이터베이스의 구축 ⑦ 매스컴(인터넷ㆍ TV 등)을 이용한 공개 수배ㆍ 수사의 강화를 제시하였다.

영문 초록

At present, the number of the missing persons is 64,000 every year as missing child or adult reported to the police in Korea. This means 170 persons are gone a day(1 person per 8 minutes) on the average. Despite the seriousness of such missing persons problem, the police's service management and investigation system on the missing person has considerable points. Alternative plans for the missing persons problem can't be searched easily at present situation, also the existing scientific studies and discussion about it are nearly rare. We examined the present condition of the police's service management and investigation on the missing person(missing child and adult). And through grasping its problems, we presented the desirable improvement plans for it. We presented that ① the enactment of law about the missing person ② the establishment of the center taking whole charge of service management and investigation on the missing person and the reinforcement of the electronic arrangements ③ the construction of mutual connection system with each related organs ④ the establishment of electronic list about inmates in the protective institutions and the control and supervision of the protective institutions ⑤ the construction of DNA databases for disappeared person from home(missing juvenile and adult) ⑥ putting under an obligation of single burial of the unidentified person's body who has died an unnatural death and the construction of its DNA databases ⑦ the reinforcement of open arrangements and investigations with mass communication(Internet and TV, etc.).
