초동수사역량 강화를 통한 효과적인 범인검거방안에 대한 연구

국문 초록

신속한 범인검거는 범의를 차단하여 범죄를 통제함으로써 평온을 유지하기 위한 경찰의 책무이다. 특히 범행현장에서의 신속한 범인검거는 수사장기화의 각종 부작용을 해소할 수 있으며 범죄통제의 가장 효과적인 방책이다. 경찰에 의해 관행적으로 이루어지는 초동수사활동은 현장출동ㆍ접근, 상황보고 및 전파, 수사긴급배치 및 수배, 범죄의 진압과 체포, 피해자구호, 현장보존, 현장관찰 등을 들 수 있다. 하지만 초동수사활동의 수사권이 경찰에게 부여되어져 있는 외국과는 다르게 우리나라는 구체적인 법률적 근거가 없이 관행적으로 행해지고 있고 구체적인 개념조차 정립되지 않아 초동수사활동의 법적 보장과 초동수사활동으로 인한 권리침해 요인통제에 소홀해 왔음을 설문분석과 형사소송법 및 경찰관련법에 대한 연구를 통해 확인할 수 있다. 초동수사활동의 개념을'범인의 검거와 증거를 확보하기 위해 범죄현장 및 범죄현장과 직접 연계된 장소에서 이루어지는 사법경찰작용으로서 계속수사 이전의 수사활동'으로 정의하고 초동수사활동의 법적 근거와 권리침해적 요소에 대한 제한을 관련법규에 구체적으로 명시하여야 할 필요성을 제기하였다. 범인검거활동 중 효과면에서 가장 중요성이 높은 수사긴급배치의 운영실태를 충남지방경찰청의 국민은행 강도살인사건의 사례를 들어 살펴봄으로써 수사지휘체계의 확립, 인식전환, 매뉴얼 숙지, 출동요소의 증원과 장비의 확충을 통한 실질적 운영이 요구됨을 확인하였다. 마지막으로 경찰의 초동수사역량을 제고하기 위한 방안들을 제도, 인력, 장비면으로 구분하여 제안하였다. 제도면에서는 경찰에 대한 수사권 부여로 책임있는 수사활동의 기반을 조성하고, 인력면에서는 초동수사활동 참여경찰관의 증대ㆍ수사지휘관의 육성ㆍ지속적인 훈련을 제안하며, 장비면에서는 페인트 발사기ㆍ레이저광선총 등 순간 제압장비의 개발과 보급, 차량의 차단장비 활용ㆍ보급을 들었고 범죄지리정보시스템의 개발 보급을 통해 과학적인 지휘체제의 확립으로 총체적으로 초동수사역량을 높이는 방안들을 제시하였다.

영문 초록

Rapid arrest of criminals and peace keeping by controlling crime through suppression of the crime motive is a main duty of the police. In particular, arrest of the criminals on the crime scene is the most efficient method which can solve such problems as delayed investigation and other side effects. Preliminary investigation consisting of arriving and approaching to the scene, reporting and dispatching of information, prompt deployment of officers, crime control and arrest of criminals, emergent care of the victims, and securing and observation of the crime scene is customarily carried out by the field police officer. However, the field officer who is not accordingly empowered by law conducts the preliminary investigation. Moreover, the concept of preliminary investigation still has not been generally established and accepted by this time. This has led to not only negligence of legalization of preliminary investigation but also human rights infringement. This presumption is supported by the survey of police officers and relevant study of Criminal Procedure Act and other police-related legislation. In this research, the concept of preliminary investigation is proposed as "investigative activities in the crime scene and its surroundings in order to arrest criminals and secure the evidence prior to ordinary investigation process". The necessity of legal provisions of preliminary investigation and restriction of human rights violation are also proposed. Kookmin bank incident, a bank robbery case of Chungnam Provincial Agency is analyzed for a failure case of immediate police response. In this regard, it is necessarily recognized that the establishment of command control system on the scene is important. Additionally, it is required to supplement sufficient officers and equipment and fullest use of manuals in order to conduct proper preliminary investigation. In conclusion, this study presents several recommendations to enhance the usefulness of preliminary investigation in terms of system, personnel, and equipment. With regard to the system, it is proposed that the legal basis of investigative activity should be formed by empowerment of investigative authority to the police. With regard to personnel, training of commanding officer in investigation, continuous education based on the manuals, and the enhancement of basic skills such as gun shooting are suggested. Concerning the equipment, development and supply of non-lethal police weapons like paint shooters and laser beam guns, the use of vehicle control equipments and portable road spikes are suggested. Hi-tech command control device like Crime Geography Information System is also recommended to be introduced for the facility of preliminary investigation.
