수사경찰의 피해자보호방안에 관한 연구

국문 초록

범죄피해자대책은 피해자의 법적 지위를 확립하고 피해자에게 필요한 것을 제공하기 위한 국가 또는 공공단체뿐만 아니라 개인 또는 민간단체의 모든 노력이라고 할 수 있다. 즉 범죄피해자의 법적 지위를 확보하기 위하여 노력하고, 범죄피해자에게 적절한 보호를 위해 실시하는 모든 조치를 비롯하여 피해자의 자립과 재활을 지원하거나 고통을 완화하려는 국가 또는 공공단체ㆍ개인 또는 민간단체의 활동이 모두 피해자보호 활동에 포함된다. 오늘날에는 피해자 권리보장을 위한 활동이 개별 국가를 넘어 국제적 차원으로 발전하면서 피해자보호 활동도 더욱 다양해졌다. 일반적인 피해자보호의 방향은 범죄피해자에 대한 경제적ㆍ사회적 또는 정신적ㆍ심리적 지원과 형사사법절차에서의 피해자 지위 강화와 그의 권익 옹호를 위한 조치를 꾀하여야 하겠다. 우리의 경우 범죄피해자에 대한 관심은 헌법을 비롯하여 형사소송법상의 배상명령제도,'성폭력범죄의 처벌 및 피해자보호 등에 관한 법률'과'가정폭력범죄의 처벌 등에 관한 특례법'등 개별 법률을 통한 범죄피해자의 보호, 범죄피해자구조법상의 보상제도에서와 같이 피해자보호 등을 위한 꾸준한 입법적 노력을 통하여 그 초석은 다졌다고 할 수 있다. 더욱이 2004년에는 총괄적이고 체계적인 범죄피해자보호ㆍ지원을 위하여'범죄피해자기본법'을 마련하여, 피해자보호ㆍ지원에 있어서 새로운 전기를 맞이하게 되었다. 이 글은 그동안 논의된 수사기관의 피해자 보호방안에서 간과한 내용은 없는가를 범죄피해자 관련 입법을 중심으로 살펴보고, 범죄피해자의 보호를 위하여 관련 법률에서 세부적으로 다듬어야 할 내용과 일반적으로 논의되고 있는 범죄피해자대책에서 개선되어야 할 사항을 제시하였다.

영문 초록

Crime Victims Support System is the maximum amount of effort of the nation, public agency, and individual or private organization to offer what victim needs and establish his or her legal status. That is whole activities - such as trying to ensure victims legal standing, providing proper aids to protect victims, and helping victims to support themselves - that they do are included in Crime Victims Support. Recently, activities for victims right protection are expanded internationally over individual states and become various. General direction of victim protection has to be devised not only for supporting victims economically, socially, and psychologically but also for strengthening their legal/social standings and rights. In our cases, concerns about crime victims are consolidated through constant legislative effort - reparation order on criminal procedure system, punishment about sexual abuse and crime victim protection, and special law in punishment on domestic violence. Moreover, providing Crime Victims Fundamental Act, which was founded in 2004 for systematic protection and support of victim, makes protection and support to enter upon a new phase. In this article, we will review there is something we passed over in the criminal investigation agency or bureaus Crime Victims Support System discussed until these days. In addition, particulars and details in related laws that need to be more improved and revised for victims protection will be also suggested.
