소년사법처리 절차에 있어 경찰의 역할

국문 초록

소년의 범죄와 비행은 국가적인 차원에서 뿐만 아니라 세계적으로도 관심의 대상이 되고 있으며 형사정잭적인 측면에서도 중요한 문제로 부각되고 있다. 이에 본 연구에서는 소년 범죄를 통제하고 소년법을 집행하는데 있어서 사법기관 중 가장 선두에 있다고 할 수 있는 경찰이 청소년 보호에 어떠한 역할을 해야 하는지를 고찰하였다. 현재 우리나라가 택하고 있는 전건송치주의는 경찰의 재량권을 인정하지 않을 뿐 아니라, 소년에 대한 낙인효과를 오히려 증가시킬 우려가 있다는 결론을 도출하였으며, 미국의 경우는 비행 청소년을 선도하는데 있어서 경찰의 재량권은 우리나라보다 훨씬 광범위하였고, 다양한 민생지역 프로그램을 통해 특수하게 훈련된 청소년 선도 경찰관들과 전문가들이 지역사회에서 법의 집행과 범죄예방이라는 역할을 수행하고 있다. 이를 토대로 하여 우리나라의 소년사건처리절차 및 소년보호정책의 개선을 위하여 다음과 같이 제시하고자 한다. 첫째, 전건송치주의를 배제하여 경찰의 재량권을 확대하고 둘째, 소년법에 다양한 전환제도를 마련하여야 하며 셋째, 시민들의 지도력을 활용하여 사회안전망을 구축해야 한다. 마지막으로, 전문가들을 일선에 배치하여 경찰과 협력하여 소년범들이 성인범으로 전이 될 가능성을 사전에 차단해야 한다는 것이다. 이에 따라 본 연구는 우리나라의 소년사건 처리절차상의 문제점을 지적하고, 미국에서의 경찰의 역할과 경찰이 시행하고 있는 다양한 프로그램들을 소개함으로써 소년보호에 있어서 경찰의 중요성을 다시 한번 부각시킨 점에서 의의가 있다고 하겠다.

영문 초록

The purpose of this study is to see through how juvenile delinquents are treated and processed under the judicial system and the police discretion in handling juveniles by comparing the United States and Korea. Also, I wish to present the trend of juvenile crime, which is occurring to serious problem of modern society, and the improvement of the process in juvenile justice system. The initial contact between a juvenile and the criminal justice system is usually handled by a police officer, so in this study, I examine that the role of the police officer, who must decide how to handle juvenile delinquents. Since, the police represent the front lines of delinquency control and prevention, they usually are an essential part of a juvenile's first official encounter with the juvenile justice system. According to examining result, 'forwarding prosecution' which present Korea is choosing now, cannot only recognize discretionary power of police, but also stigmatize juvenile as a felony. On the other hand, in the case of the United States, juvenile police officers and experts who are specially trained, are achieving 'law enforcement and crime prevention role' through the various community policing programs in local community, and police discretion in juvenile justice system is more extensive than Korea. Therefore, to improve the process in juvenile justice system, first, we have to exclude 'forwarding prosecution' and extend the discretionary power of police. Second, the various diversionary system need in juvenile law. Third, we have to construct social safety net with taking advant- age of leadership of citizens. Forth, the experts have to cooperate with the police to intercept the possibility, which juvenile delinquents are changed to criminals. This study is somewhat meaningful proved that the importance of police's role is embossed in juvenile policy by pointing out problems in Korea and introducing police's role in the United States and various programs that the police are enforcing.
