대형 민간경비업체 종사자의 민간조사제도의 이해 수준 연구

국문 초록

민간조사제도는 공권력의 한계로 빚어지는 국민의 피해에 수익자부담으로 국민의 권리와 생명 그리고 재산을 보호할 수 있는 제도이나 우리나라에서는 대륙법계의 영향으로 국가치안과 국민의 안전은 공권력의 고유 업무로 인식되어져온 것과 과거 흥신소의 부정적인 인식 그리고 최근 증가하고 있는 정보유출 사례와 사생활 침해의 우려로 인해 입법화가 지연되었다. 그런데 다행스럽게도 지난 3월 18일 국무회의에서 신직업 육성 추진계획에 민간조사원이 포함되어 법적 근거 마련에 힘을 얻고 있으며, 현재 국회에 계류 중인 윤재옥의원의 「경비업법전부개정안」과 같이 「경비업법」을 개정하여 민간조사제도를 도입할 경우에는 대형민간경비업체에서 민간조사업을 수임할 경우 국민들의 사생활과 정보유출로 인한 새로운 권력집단의 탄생이라는 우려를 낳고 있어 이들의 민간조사제도의 이해 수준을 알아볼 필요성이 제기되었다. 이 연구에서는 대형 민간경비업체 종사자들은 민간조사제도에 대한 이해수준을 측정한 결과 매우 잘 알고 있다(14.2%), 잘 알고 있다(62.6%), 보통(3.7%), 잘 모르겠다(11.0%), 전혀 모르고 있다(8.2%)순으로 나타났으며, 그 결과를 바탕으로 질적 분석을 한 결과 그들이 인식하고 있는 민간조사업은 흥신소, 위법행위, 언론보도, 각종정보수집, 관련협회, 공권력의 한계 등인 것으로 나타나 민간조사제도에 대해서는 대체적으로 인식하고 있으나 민간조사제도에 대한 전문적인 지식은 부족한 것으로 나타났다.

영문 초록

Private investigation institutions is a institution which can protect to people's right, life, and property in accordance with BYOB principle for people's damages because of limitation of police power but in Korea, due to effect of the legal system of continent, public safety and safety of people have been considered as government's own business by people and negative awareness of private detective agency in the past and case in recently increasing information leakage and concern of invasion of privacy by people. accordingly lawmaking have been delayed. By the way, luckily in the past 18, March at the cabinet conference private investigation is involved in new occupation fosterage plan. so, to establish a legal basis is getting power. The present, we need to examine thoroughly already formed awareness of domestic private security workers when we adopt private investigation institution by amending 「Security Services Industry Act」 like congressman Yoon Jae Ok's pending bill 「All Amendments Private Security Act」 in assembly. The present, over the 4,000 domestic private security companies and over the 150,000 security guards have made large scale market and also structure of market have been deepened bi polarization between a conglomerate and a small business. In this study, about private investigation institute, large private security company workers showed that very well know(14.2%), Well know(62.6%), normal(3.7%), don't know well(11.0%), hardly know(8.2%) and also qualitative analysis show that private detective agency, an illegal act, a media report, intelligence gathering, related association, limitation of public power.
