선진 집회시위 문화 정착을 위한 시민의식 연구

국문 초록

그간 경찰의 집회시위관리는 민주화 이후, 문민ㆍ국민ㆍ참여ㆍ이명박 정부를 거치면서 불법폭력 시위는 반드시 사법 처리되어야 한다는 사회적 공감대를 이끌어내는데 실패하였다. 경찰도 진압과 수사상의 부담으로 인해 모든 집회시위에 대해 엄정하게 대응하지 못한 경우도 있었으며 더욱이 대다수 국민들은 시위대의 불법행위에 거부감을 느끼면서도 침묵하는 소극적 태도를 보이면서 막상 진압과정에서 발생하는 경찰의 무리한 행태에 대해서는 적극적 비난을 가하는 등 이중적 태도를 보여온 것도 사실이다. 따라서 집회시위가 가지는 순기능을 인정하면서 그것이 사회질서를 훼손하지 않도록 적절히 관리하고자 애쓰는 균형있는 경찰의 시각과 대책이 그 어느때 보다 필요한 시점이다. 이 연구는 집회시위시 경찰의 법집행에 대한 시민들의 인식과 순응의 정도변화를 통하여 향후 선진화된 집회시위 문화 형성에 정책적으로 제언하기 위한 목표로 진진행 되었으며 지난 5년간의 집회시위시경찰 법집행에 대한 인식은 상당부분 개선되었으나 아직도 대화를 위한 정부의 적극적 노력, 시민들의 성숙된 법준수 의식 그리고 경찰의 인권배려적 법집행에 대한 기대와 당부가 높게 나타나고 있다. 따라서 이러한 부분들에 대한 개선을 위하여 형사사법 당국은 국민의식의 성숙된 변화를 유도하기 위한 지속적인 노력과 홍보 강화에 힘써야 하고 이해갈등 시스템을 구축하고 법집행에 대한 일관성 확보를 위한 부단한 노력이 선행되어야 할 것으로 본다.

영문 초록

In managing assemblies and demonstrations after the democratization of South Korea, the police failed to reach a consensus of the society that unlawful violence and demonstration shall be judicially treated without fail at the times of Civilian, People's, Participatory and Lee Myung-Bak Administrations. In some cases, the police could not strictly stop up all the assemblies and demonstrations due to burdens related to suppression and investigation. Moreover, in fact, most of the people showed a dual attitude since they felt objections to unlawful behaviors of demonstrators but remained silent in a passive manner while actively criticizing unjustifiable actions of the police which took place in the process of suppression of demonstrations. At this juncture, it is really necessary for the police to acknowledge a positive function of assembly and demonstration and have such a balanced notion and/or scheme to appropriately treat assembly and demonstration so that they may not damage the order of the society. This research is aimed to make policy suggestions for the creation of advanced assembly and demonstration cultures in the future, after an analysis is made of changes in the recognition and compliance of citizens concerning the police's law enforcement against assembly and demonstration. Over the past 5 years the people's recognition of police law enforcement has been much improved, yet their expectation and request are still high to encourage the government's active efforts for dialogue, citizens' law-abiding spirit, and the police's law enforcement in consideration of human rights. Accordingly, first of all to make the above-mentioned improvements, it is needful that the criminal authorities should ceaselessly make more endeavors and advertisements to mature the civic consciousness, construct a system to resolve conflicts of interests, and secure the consistency of law enforcement.
