개인정보보호를 위한 공공-민간부문의 협력 전략

국문 초록

현대사회에서 개인정보는 공공 부문에서 행정 효율성을 제고하고 맞춤형 서비스를 제공하기 위해서 또는 민간부문에서 마케팅 등의 목적으로 폭넓게 활용되고 있다. 하지만, 만약 누군가에 의해 개인정보가 악의적인 목적으로 이용되거나 유출될 경우 개인의 안전과 재산에 커다란 피해를 줄 수도 있다. 이에 이 연구에서는 우리사회의 안전을 위협하는 대규모 개인정보 유출 사고에 대응하고 개인정보보호 정책의 시너지 효과를 극대화하기 위해서는 공공과 민간부문의 협력이 필요함을 주장하고 이와 관련된 몇 가지 전략을 제시하였다. 첫째, 개인정보 유출 및 사고에 효율적으로 대응하고, 공공-민간의 협력체제 구축을 포함한 개인정보보호 관련 정책의 수립ㆍ집행ㆍ감독업무를 통합하여 관장할 수 있도록 개인정보보호 전담기구를 신설하여야 한다. 둘째, 민간의 자율 규제와 정부의 감독을 조화하는 방안을 모색해야 한다. 민간기업의 자율 규제환경을 마련하기 위해서는 정부의 상시적이고 철저한 감독 시스템이 필수적이며 정보 유출기업에 대한 엄중한 법적 제재도 필요하다. 또한 '기업보안 등급 공시제'의 실시로 기업 간의 자연스러운 정보보호경쟁을 유도하고 일본의 '인정 개인정보보호단체'를 참고하여 민간단체에 의한 자율규제를 존중하고 이를 정부가 지원하는 체제를 구축하여야 한다. 셋째, 개인정보 유출 시 피해 확산방지 및 피해복구를 위한 조기경보 협력 시스템의 구축을 위해 데이터 침해 공시를 의무화하고 위반 시 엄중한 법적 제재를 부과해야 한다. 또한 개인정보의 침해 시 개인정보주체가 이를 즉시 보고하고 정부 및 관련 기업이 이와 같은 침해사실에 실시간으로 접근이 가능하도록 하는 시그널 스팸과 같은 시스템을 마련하여야 한다. 마지막으로 수사기관, 민간기업, 보안 업체, 연구소 등이 개인정보 유출과 이와 관련된 범죄에 대한 최신 정보 및 기술의 교환, 정보보안 의식과 보안교육을 위한 인적 교류, 세미나 개최를 통하여 수사력과 기술력을 조화시키는 긴밀한 공조ㆍ협력 체제를 구축하여야 한다.

영문 초록

In the contemporary society, personal information is utilized widely throughout public and private areas for various purposes including higher administrative efficiency, customized services, and target marketing. However, malicious misuse or leakage of personal information by a third party may bring forth immense losses to the persons' safety and property. Thus this study underscored the necessity of cooperation between public and private sectors and suggested a number of strategies for coping with large-scale personal information leakages threatening the safety of our society and for maximizing the synergy of personal information protection policies. First, an organization committed to personal information protection should be established in order to cope with personal information leakages and accidents efficiently, and to integrate the tasks of making, executing and supervising policies related to personal information protection including the establishment of public-private cooperation systems. Second, it is necessary to support private sectors' autonomous regulation, to build up permanent strict supervision systems, and to take severe legal sanctions against companies leaking personal information. Moreover, the 'business security level disclosure system' may induce competition for information protection among companies, and government-sponsored selfregulation systems may be established by private organizations with reference to 'authorized personal information protection organizations' in Japan. Third, for building early warning systems to check the spread of leaked personal information and to recover from damages, it should be obliged to report data infringement, and severe legal sanctions should be taken against violations. What is more, it is required to establish signal spam systems that, on personal information infringements, enable the government and involved companies to access such facts in real time. Lastly, a close mutual assistance-cooperation system should be established that integrates the investigative and technological competences of investigation agencies, private businesses, security companies, research institutes, etc. through exchanging up-to-date information and technologies, promoting personnel exchange for information security education, and holding related seminars.
