연명의료 결정에 대한 법 제정과 현실

국문 초록

보라매병원 사건과 김 할머니 사건에 대한 법원 판결을 통해 우리 사회는 연명의료에 큰 관심을 갖게 되었고, 정부는 법제화를 추진하고 있다. 그러나 연명의료에 대한 사회적 합의가 충분치 않은 현 상황에서 연명의료와 관련된 사안들을 법의 잣대로 해결하려는 것은 또 다른 생명경시 풍조를 유발할 우려가 있다. 먼저, 무의미한 연명의료 중단에 대한 결정은 가족회의에서 환자, 보호자(가족)와 의료진간의 충분한 정보 교환, 소통과 협상을 통해 이룰 수 있어야 한다. 이를 위해 의료인이 충분한 시간 상담할 수 있는 환경, 의료인들에 대한 의사소통방식이나 내용에 대한 교육과 일반인들을 대상으로 한 연명의료에 대한 홍보 등 여건 조성이 선행되어야 한다. 또한 호스피스와 완화의료가 절망 속에 있는 말기 환자와 임종기 환자들에게 자기 결정권을 행사하여 선택할 수 있는 하나의 의료여건이 될 수 있도록 호스피스-완화의료 제도의 정비 및 활성화가 선행되어야 한다. 따라서 연명의료 결정에 대한 법제화는 여건 조성을 먼저 이룬 후에 추진되어야 할 것이다.

영문 초록

In 2009, Supreme Court of Korea proposed the criteria of withholding or discontinuing life-sustaining treatments. This adjudication of the court aroused a lot of public debate as well as interest about the end-of-life decision making. The legislation for the conditions and process of decision to forgo life-sustaining treatments is being pushed by the government without social consensus, concerning about arising the trend of contempt of life. The function of family conference at which most of the end-of-life decisions for patients were made should be enhanced. In family conference, opportunities to listen and respond between patient, family members and clinicians is important to make the decision. It is necessary to educate the family members as well as the clinicians about the content and process of communication about end-of-life care. Patients and family members at the end of life mainly required symptom managements. But end of life care such as hospice care and palliative care was commonly superseded by potentially curative or restorative treatment designed to sustain life but not necessarily to comfort a patient at the time of death because of lack of and inappropriate end-of life care system. It is necessary to promote the end of life care systems including hospice care and palliative care. Prior to the legislation, it is necessary to improve and innovate the decision making system and end of life care system.
