사전의료의향서 논란을 통해서 본 죽음에 대한 바람직한 인식

국문 초록

생명윤리는 인간의 삶의 시작에서부터 끝에 이르기까지 이루어지는 모든 현상들을 그 내용으로 한다. 특히 죽음은 누구나 겪어야 하는, 생명현상에 있어서 하나의 과정 이지만 어느 누구도 직접 경험하지는 못했다. 단지 내 주변의 가족이나 친지들의 죽음사건을 통해서 간접적으로 경험할 뿐이다. 그래서 인간은 죽음을 두려워하면서 일상 안에서 죽음에 대하여 생각하기를 꺼려한다. 그러나 또한 역설적으로 죽음을 알아야만, 한 인간의 삶의 방향이 올바로 설 수 있다. 죽음은 곧 삶의 문제이기 때문이다. 최근 우리사회에서 이 죽음의 문제에 대한 많은 사건들과 논의가 있다. 존엄사로 불리는 안락사, 사전의료의향서, 연명의료중단, 호스피스 완화의료 등과 같은 죽음에 직면한 사안들에 대한 문제부터 도시 내의 납골당 설치문제, 화장장 시설, 묘지시설, 심지어는 사이버 세계 안에서의 사망자 처리문제 등이 대두되고 있다. 특히 1997년 '보라매병원사건'과 2009년 '연세대학교세브란스병원사건'을 통하여 죽음에 임박한 환자들에 대한 의사결정에 관한 문제가 대두되기 시작하였다. 특히 이러한 인식의 연장선상에서 '사전의료의 향서' 도입을 포함한 연명의료중단에 대한 법제화 움직임도 일어나고 있다. 본 연구를 통해서 죽음에 대한 올바른 인식과 임종기 환자들에 대한 의료적 입장들에 대한 점검을 통해서 '사전의료의향서'의 타당성과 연명의료중단에 대하여 알아본다. 더 나아가 우리사회가 생명에 대한 올바른 가치정립을 통해서 생명존중문화를 이룰 수 있도록 돕고자, 죽음에 대한 바람직한 인식을 모색한다. 죽음의 문제에 있어서 논란이 야기되는 측면은, 임종기 환자 또는 중증환자들에게 행해지는 의료행위이다. 이 문제에 대하여, 생명을 소중히 여겨야 한다는 측면에서는 대부분 동의하지만, 일련의 의료행위에 수반되는 인적, 물적 자원에 의해 과도한 치료를 행함으로서, 환자본인과 의료진 그리고 환자의 가족들 간의 입장이 상반되기도 한다. 따라서 임종기 환자에 대한 의학적, 윤리적, 사회적, 법적 상황들에 대한 연구를 통해서, 이에 대한 바람직한 인식을 이끌어 내고자 한다. 최근 대두되고 있는 '사전의료의향서'에 대하여 살펴보고, 법제화의 움직임에 대하여도 진단해 보고자 한다. '사전의료의향서'에 대한 올바른 이해와 판단을 통해서 그 문제점이 무엇인지 알아본다. 동시에 가톨릭교회의 입장을 살펴봄으로써 생명존중의식에 입각한 바람직한 죽음에 대한 인식의 토대를 마련해보고자 한다.

영문 초록

The issue of death is very important for discussing bioethics. Death is unavoidable and it is one of the processes of a life cycle. However, it is the event that anyone couldn't directly experience before. People only indirectly experience death through that of family members, relatives and companies. Therefore, people avoid thinking about death in their life while they are afraid of it. Ironically, since death is also the matter of life, people can be in the right direction in life when they think about death. Recently, there have been many cases and discussions about the issue of death. For example, there were some direct issues of death such as Euthanasia, Advanced Medical Directives, suspension of life sustaining treatment and a hospice treatment. Also, some issues are arising like building charnel houses, crematoriums and burial grounds in the city area and the treatment of the dead in the cyber-world. Especially, the issues of decision-making for patients who are about to die were arising from the incidents of Boramae Hospital in 1997 and Severance Hospital in 2009. In addition, the movement of making a law for suspension of life sustaining treatment, including advanced directives, is emerging. In this study, the validity of Advanced Medical Directives and the right direction of suspension of life sustaining treatment for people near death are discussed. Furthermore, this study seeks to help our society to form the Pro-Life culture through desirable understanding of death. The controversy over death is the medical treatment for patients near death or with a serious case. Most people generally agree with the fact that one's life itself should be respected. However, some excessive medical treatments that are using human and material resources can be controversial among patients, medical staff and patient's families. Therefore, desirable understanding for patients near death will be dealt with through medical, ethical, social and legal studies. This study deals with suspension of life sustaining treatment, which is recently managed by social organizations and insurance companies, and the movement into legalization. From the past experiences in South Korea, unfortunate situations happened when improper understandings of things were legalized. Therefore, the need of right understanding and judgement about suspension of life sustaining treatment through comparison of many different perspectives, and applying them to our society are examined. At the same time, awareness of Pro-Life will be built through the perspective of the Catholic Church.
