베트남 토지등록제도에 관한 연구

국문 초록

본 연구는 통일 한국시대에 문제시 될 북한의 토지등록에 대한 사전적 준비를 위해 사회주의 국가의 토지등록 제도를 검토하여 북한에 적용 가능한 토지등록 모델을 구현하는 것이다. 연구목적을 달성하기 위해 연구범위는 자본주의와 사회주의가 공존하였던 국가중 베트남으로 한정하였으며 베트남 토지법을 적용하였다. 조사방법은 문헌조사를 통한 2차 자료를 수집하였으며, 접근방법은 현지 인터뷰를 통한 연구방법으로 수행하였다. 연구결과는 베트남 토지등록은 토지사용구상(planing) 및 계획(plan) 수립, 토지 배분 및 토지회수, 토지사용권의 등록, 토지가격의 결정 등 크게 4가지로 구분할 수 있었다. 그러나 토지등록제도의 문제점으로는 토지법과 토지에 관련된 법률이 서로 충돌되고 있었으며, 토지자원은 국가의 경제 사회발전을 위한 중요한 힘이 되기 위해 효과적으로 사용되지 않고 있었으며, 토지관리 행정업무 실행 시 많은 제한이 존재하고, 토지법의 규정은 토지소유 대표자로써 국가의 결정권 실행에 대해 분명하게 표현되지 않았으며, 토지분쟁 및 소송 해결에 관한 법률규정은 사실의 요구를 충족시키지 못하고 있었으며, 마지막으로 부동산시장에 속한 토지사용권은 많은 약점을 보여주고 있었으며 토지에 관한 행정업무절차는 매우 복잡하고 업무처리기간이 상당히 길어 부정부패가 만연할 소지가 있다는 것으로 연구되었다.

영문 초록

The goal of this study is to realize a land registration model that can apply to North Korea in order to be prepared in advance for land registration in North Korea, which can be a matter of concern in the era of the unified Korea, by examining the land registration system of a socialist country. The study range is limited to Vietnam and its land law amongst the candidate countries and their land administration environment where capitalism and socialism coexisted in order to achieve the purpose of study. Secondary data collection in the literature review has been conducted for survey method and study through local interviews has been conducted for approach method. The result of this study on the land registration system in Vietnam has been classified into four major categories such as land use planning and plan, land allocation and land recovery, land-use right registration, and pricing decisions on land The land registration system, however, revealed a numerous problems: the land law and the land-related laws often come into conflict with each other; land resources are not in their most effective use to be an important driving force for economic and social development of the nation; the administrative duties for land management face many limitations when they are to be earned out; the regulations of the land law have not clearly stated about the final say of the nation as the representative of land owners; the regulations on the settlement of land dispute and lawsuit fall short of demands in reality; the land use right in real estate market shows much vulnerability; and the land administration procedure in Vietnam is so complicated and usually involves much delayed task handling duration that it can engender widespread graft and corruption.
