국민행복 실현의 동반자로서 사회적 약자의 보호에 관한 일고찰

국문 초록

2012년 12월 19일 제18대 대통령선거에서 당선된 박근혜대통령은 창조경제와 국민행복실현을 가장 우선적인 실천과제로 제시하였고, 이에 발맞추어 정부의 각 부처와 나아가 국가정책연구원 등이 앞 다투어 창조경제의 방안을 제시하고 있다. 창조경제를 통하여 실현하고자 하는 것은 결국 국민의 행복실현이다. 국민행복의 실현에 있어서 한 가지 간과하지 않아야 하는 것이 바로 소수자 또는 사회적 약자 보호의 문제이다. 사회적 약자 및 사회적 소외계층에는 그 대상으로서 장애인, 노약자 및 다문화가족 등으로 분류할 수 있으며, 그 영역별로 정치적 영역ㆍ경제적 영역 및 사회적 영역으로도 분류할 수 있다. 소수자의 보호 또는 사회적 약자의 보호는 보다 완전한 사회통합을 이루는 계기로 작용할 뿐만 아니라 보다 진전된 선진국가로 나아가는 시금석이 될 것이라 점에서 헌법의 중심문제가 되는 것이다. 본고에서는 사회적 약자에 대한 이론적 논의는 생략하고 헌법 상 규정된 각 영역별 사회적 약자의 보호에 한정하여 일고찰하고 그 대안적 방안도 함께 제시하고자 한다. 본고에서 다루게 되는 것은 첫째, 정치적 영역에서의 사회적 약자의 보호(기탁금제도에 관한 것임), 둘째, 경제적 영역에서의 사회적 약자의 보호(농ㆍ어민 및 중소기업의 보호ㆍ육성과 소비자보호), 셋째, 사회적 영역에서의 사회적 약자의 보호(특히 시각장애인의 보호) 등이다. 창조경제를 통하여 실현하려고 하는 것이 눈앞의 경제부흥과 나아가 이러한 경제부흥의 지속적인 발전을 구가하는 것이라 하여도 그 내용면에서 소수자 혹은 사회적 약자의 보호를 중요하게 고려하는 것이어야 한다. 그러한 점에서 창조경제와 사회적 약자의 보호를 통한 사회통합의 실현은 별개의 문제가 아니라 하나의 문제가 되는 것이다. 소수자와 사회적 약자 또한 인간으로서 존엄과 가치를 당연히 누릴 권리가 있으며, 정치ㆍ경제ㆍ사회적 영역에서 국민으로서 행복실현의 향유에 있어서 예외자가 아니라 동반자임은 너무나 자명한 것이다.

영문 초록

President, Park Geun hye to have win on election on December 19 2012 proposed Creative Economy and realization of national happiness. And moving pari passu with the proposition, each government ministry and National Strategy Institute are drawing up a plan of Creative Economy. The goal of Creative Economy is definitive realization of national happiness. The protection of minorities or the weak through the realization of national happiness is a problem that cannot be ignored. The weak and neglected class of people include the old and the infirm, the disabled and multi-cultural family. And they are classified as political, financial and social domain. It is crux of the matter of constitution that protection of minorities or the weak come into social integration futhermore it become the touchstone of advanced nation. This research paper dispense with theoretical discussion only just consider protection of areal the weak at the set constitution. And supplementarily suggest an alternative. The contents of the paper are as in the following; 1st, protection of the weak in the field of politic -details about donation system; 2nd, protection of the weak in the field of economy -protection of farmers and fishmans, promotion of small and medium firms and protection of consumers; 3rd, protection of the weak in the field of society -especially details about the blind. The policies of Creative Economy must consider protection of minorities and the weak in contents although the policies seek short-time economic development or continuous economic growth (in objective). In that regard it is a problem common to both, if anything to realize social integration by Creative Economy and protection of the weak. Minorities and the weak have the human right to enjoy debase and value as human. And it is obvious that they are partners in the field of politics, economy and society not outlier of enjoying happiness as people.
