영문 초록

This study, considering the cultural environment in Korea, which shows strong abhor about the crime, analyzed that, based on the "Shaming Theory" of Brathwaite and the "Defiance Theory" of Sherman, what factors affect reintegrative shaming and stigmatizing shaming adolescent criminals feel and what conditions maximize reintegrative shaming and minimize stigmatizing shaming. And besides factors that Braithwaite maintained, I try to find out factors that can have affect on a sense of shame of Korean adolescents-it is different from the one of western adolescents- and the basis of development in policy for criminal preventing suitable for our environment. We can suggest several factors that affect the shaming of the criminals, but m this study, I will find out how the criminals' awareness about the interdependency Braitheaite stated and the fairness of the punishment Sherman pointed out affects the shame that criminals feel and factors that can affect reintegrative shaming, and think of the ways that can maximize this. In order to do this, in a correction institution for juveniles, I will do a survey requiring self-reporting questionnaires about what they felt about fairness when they were going through legal procedures, how much they knew about the damage they did to others by committing crimes, and how much responsibility for the society they have. As a result of the study, the most influential factor that affect reintegrative shaming is, like in the study by Braithwaite, something related to the interdependence, in addition to it, there are some factors; awareness of responsibility about the result of the crime, the level of awareness of victim and the awareness of severeness about their behaviors. It was proved that the more negative toward the fairness of the punishment they were, the more stigmatizing shaming they had; we know, from this result, that the police need constant efforts to improve their image to the public and restore trust from the people around them. As the interdependence, the awareness of responsibility, and the awareness of severeness of the criminals gets strong, the reintegrative shaming that plays a big role on decreasing the crime rate takes more hire position, and because the more negative toward the fairness of punishment the one is, the bigger the stigmatizing shaming gets and one can easily be attracted by recidivism, we need to establish trust and strong social bonds in communities, schools, and workplace in order to prevent the juvenile criminals from committing crimes again. People around the criminals should show generous attitudes towards them rather than stigmatizing stance so that the criminals might not lose affection. The cognitive level of seriousness in deviance can be increased by the VIS and the VOM. A liability and cognizance of victim's damage can be increased by same methods. Police officers should improve on fair image. These consequences would fit in well with the restorative justice program. And It is timely choice that establishment of 'Korea Center for victims of crime' in 2005.
