국문 초록

형사사법에 있어서 범죄의 가해자가 있으면 그에 따른 범죄피해자도 있게 마련이다. 그럼에도 불구하고 그동안 형사정책은 가해자의 인권보호에 편중되었고 상대적으로 범죄피해자는 사건해결을 위한 증거수단이나 증인의 객체로 취급되어온 측면이 있다. 국민들이 우리나라의 법집행기관들에 대해 신뢰도가 낮은 이유도 언론매체를 통하거나 형사사법기관을 접하는 과정에서 신뢰할 만한 경험을 하지 못하였기 때문이다. 이로 인해 형사사법기관에 의한 2차 피해가 발생하고 범죄피해자들은 수사기관의 협조를 꺼리게 되는 악순환이 계속되었다. 따라서 이 연구에서는 우리나라 범죄피해자지원제도의 문제점을 효과적으로 개선하여 범죄피해자의 정당한 이익과 권리를 보호하기 위한 대안으로 다음의 세 가지 개선방안을 제시하였다. 첫째, 범죄피해자에 대한 형사절차상의 권리침해 부분의 개선이 우선적으로 이루어져야한다. 둘째, 범죄피해의 결과로 인한 부대비용 발생으로 범죄피해자는 경제적으로 고통을 당하게 되므로 물질적 지원을 통해 피해자를 경제적으로 안정화시켜야 한다. 셋째, 범죄피해자들은 경제적, 심리적, 사회적으로 다양한 지원을 필요로 하지만 이러한 지원은 국가만의 노력으로 이루어지기 어렵기 때문에 범죄피해자지원센터의 지원이 필요하다.

영문 초록

New crimes and crime victims have increased along with the rapid change in society and economic growth in the contemporary society. The crime victims are those who experience crime on the spot. Thus, they can give crime related information to the jurisdictional authority more than anyone else, and play an important role in finding substantive truth by means of solving crime incidents. Nevertheless, the crime victims are regarded as a means of evidence for incident or objects of an witness, and there have no due interests given to their human rights. Three alternative measures on protection system for crime victim were suggested. First, as the crime victim may suffer from infringement of human rights in the course of investigating the related incident, the improvement of rights in the criminal procedure is necessary to minimize such infringement. Second, as the crime victim is in economic difficulty and there is no sufficient compensation, the crime victim is vulnerable to other damages besides direct damage. Third, as there is insufficient crime victim support centers, the rapid recovery and accessibility are poor. Thus, it needs to rearrange crime victim support centers.
