국문 초록

이 논문의 제목은 주택임차인 보호제도와 관련한 비교법적 고찰라고 하였다. 장래에 어떠한 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측할 수는 없다. 그러나 그것이 사회질서를 규율하는 법 제도라고 한다면 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수 있는 방법이 모색되어야 한다. 특히 주택임대차 제도는 새롭게 창출된 제도라는 점에서 종래에 발생한 문제점들을 면밀하게 파악한다면, 장래에 정립될 주택임대차 제도는 보다 합리적이고 실질적 정의에 합치될 수 있을 것으로 보여 진다. 특히 타인의 주택을 이용함에 있어서 임대인과 대등한 관계에서 임차인이 계약을 체결하는 것은 용이하지 않다. 왜냐하면 당사자들이 합의에 기하여 임대차 계약의 내용을 형성할 경우에 사실상 임대인의 이익을 위하여 계약관계가 형성될 수밖에 없는 한계가 있기 때문이다. 이러한 점을 고려한다면 임대차계약에 있어서 임차인의 법적 지위는 불안정한 상태라고 볼 수 있다. 따라서 당해 임차인의 법적 지위를 보호하기 위한 제도적 장치가 마련될 필요가 있다. 이러한 이유로 경제적 약자인 주택임차인의 생존권 내지 주거생활의 안정을 보장하기 위하여 주택임대차보호법이 제정되었다. 이 법률은 사회정책적인 차원에서 임차인을 보호하고 있다. 또한 현대사회에 있어서 국민의 주거생활은 보다 다양하게 변화되고 있는 실정인데, 주택임대차보호법도 이러한 변화를 반영하여 지금까지 12차례의 개정이 있었다. 물론 수차례의 개정을 통하여 종래의 문제점들이 개선되기도 하였지만 여전히 보완되어야 할 부분들도 적지 않다. 특히 현행 주택임대차보호법은 외국의 입법례에서 거의 찾아볼 수 없는 특수한 법률로 생성 및 발전되어 왔으며, 서민의 주거생활의 안정을 목적으로 제정된 법률이라는 점에서 민법에 대한 특별법적 성격과 사회법적 성격을 가지고 있다. 이 논문에서 저자는 비교법적 측면에서 주택임대차 제도와 관련한 주요한 내용을 검토하였는데, 특히 주택임대차 제도에 있어서 대항요건, 적용범위, 차임 등과 관련한 문제점을 중심으로 검토하였다.

영문 초록

The title of this thesis is “A Comparative Study in connection with the Protection System for Residential Lessee”. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Since Housing Lease System is something that is being newly developed, a thorough examination of past problems can lead to a future Housing Lease System that is more rational and accords with substantial justice. In using of others' real estate, it is actually impossible for a tenant to make a contract with a landlord in equal status. And even after the contract, a tenant's right of lease was still in unstable condition, which leaded to raise the problem of tenant protection. So it was definitely necessary to develop the protection measure for the problem. Therefore, the Housing Lease Protection Act was enacted on Mar. 5, 1981, to protect the housing tenant's the basic right to live and the stability of housing life and started to provide the protection for tenants in social political prospect. In modern society, an aspect of the national housing life often changes depending on the change of social affairs. So, the Housing Lease Protection Act was enacted responding to the changing of the times and since then, it has been improved many problems presented by amending twelve times. However, there are still lots of things left to be desired. The house lease system has been generated and evolved into a peculiar law that can not be found in the example of foreign practices or legislations. The Housing Lease Protection Act was established for the purpose of stable residing lives for commonality, and has the feature of special law and social law from the viewpoint of the civil law. The Ministry of Justice is trying to promote the introduction of plans that can effectively secure the rapid recovery of security as part of plans to settle this social dispute–Enactment Proposal for the Introduction of Security Insurance System for the Returning of the Deposit Money and Improvement of Civil Law System issued by Office of Legal Counsel within the Ministry of Justice. I explained about the main contents of Housing Lease System and dealt with the important contents of Housing Lease System and suggested especially the problems and improvements in connection with the opposition factor, the scope of application and rent in Housing Lease System.
