골프회원권에 대한 처분금지가처분과 가압류 간의 경합 시 우열관계

국문 초록

등기라는 공시방법을 가지고 있는 부동산에 대하여 가압류와 가처분이 경합할 시 선집행 우선의 원칙이 적용된다. 그러나 우리 판례는 부동산과는 달리 부동산에 관한 소유권 이전등기청구권에 대하여 가압류와 가처분이 경합할 때 사실상 가압류에 대하여 우선적 지위를 부여해 왔다. 그런데 이 사건의 경우 원고가 위 골프회원권에 대해 처분금지가처분신청을 하여 그 결정이 송달된 후 피고가 가압류신청을 하였고, 그 다음 원고가 가처분 결정 후 본안판결을 통해 회원권에 대한 명의개서를 마치기 전에 피고가 가압류에서 본압류로 이전하는 등 압류 및 환가절차에 착수하였다. 그 뒤 원고가 본안 판결을 통하여 명의개서를 마친 다음 피고를 상대로 제3자 이의의소를 제기하여 강제집행의 불허를 청구한 사안이다. 즉, 골프회원권에 대하여 가처분 결정이 송달된 후 가압류가 순차로 경료된 경우 소유권이전등기청구권의 경우와 같이 가압류가 우선하는가, 아니면 선집행의 원칙이 적용되어 가처분이 우선하는가 여부 등이 문제된 사건에서 대법원은 가처분 결정 송달 이후에 실시된 가압류 등의 보전처분 또는 그에 기한 강제집행은 가처분의 처분금지효에 반하는 범위 내에서 가처분 채권자에게 대항할 수 없다고 판시하였다. 이는 골프회원권과 같은 채권에 대한 보전처분 경합 시 집행순서에 의하여 우열을 결정하는 원칙을 확인한 판결로서 기준이 명확하고 예측가능 하여 보전처분이 경합 시 우열관계를 간명하게 처리할 수 있다는 점에서 대상 판결의 결론은 타당하며 결론에 찬성한다. 골프회원권의 경우 골프장 운영회사의 승인이 있어야 양도의 효력이 생기는 특수성이 있음에도 선집행우선설을 취한 것은 향후 일반채권 사이에도 이와 결론을 달리할 만한 특별한 사정이 없으므로 채권의 일반에도 같은 태도를 유지할 가능성이 크다고 본다.

영문 초록

Principle of procedural priority is applied when provisional attachment and injunction on real estate, which has a method of public announcement called registration, is put into competition. However, unlike the real estate, our precedent virtually granted preferred status on injunction when provisional attachment and injunction were put to compete regarding the claim for ownership transfer registration of real estate. In this case, the defendant requested for provisional attachment after the decision of plantiff's request for injunction for prohibition of disposition was dispatched. Thereafter the defendant launched the procedure of attachment and conversion such as transferring provisional attachment to practical attachment before the plantiff completed entry of a change of a holder in the membership through judgement on the merits after the decision of injunction. Afterwards, having completed the entry of a change of a holder through the judgement on the merits, the plantiff raised against the defendant and claimed disapproval of compulsory execution. In other words, when a case has risen regarding if provisional attachment was completed after decision of provisional disposition regarding golf membership was dispatched, same as the case of claim of ownership transfer registration, whether provisional attachment or injunction by applying principle of procedural priority should be prioritized is the problem, the supreme court has come to the judgement that preservative measure such as the provisional attachment implemented after the decision of provisional disposition or the compulsory execution of due date cannot go against a person who claims provisional disposition in the situation where the effect of prohibiting disposition of provisional disposition is opposed. Conclusion of the subject ruling is a verdict that has verified a principle that decides the superiority according to execution order when a preservative measure of a bond such as the golf membership is put to compete. The standard is accurate and predictable which allows the relationship of superiority to be clearly taken care of which therefore, makes the ruling valid. Despite the fact that in order for the transfer to have effect golf membership requires the approval of golf management company, which is a special case, the decision to take theory of procedural priority shows there is a high probability that they will make the same decision regarding general bond since there are no such exceptional cases among general bond that will conclude in a different way.
