공공재 공급수단으로서의 민간수용: 경제학적 분석

국문 초록

본고의 목적은 민간수용으로 인해 발생할 수 있는 비효율성 문제를 법제ㆍ이론적으로 검토하고, 사례분석을 통해 이를 실증적으로 고찰하는데 있다. 민간수용에 대한 기존법적ㆍ경제적 접근을 개관한 후, 민간수용이 현실에서 공익성ㆍ거래비용 조건을 제대로 충족시키지 못했다는 관찰을 우선 제시한다. 이어 설령 민간수용의 효율성 초건 (공익성ㆍ거래비용ㆍ정당보상ㆍ생산효율성)이 전제되더라도 ‘민간 고유의 유인(즉, 이윤극대화)’과 ‘제도적 불완전성(즉, 공공의 감독실패)’이 잘못 결합됨으로써 비효율적 토지선택, 과다수용, 민간기회 주의로 인한 각종 부작용(사업취소, 압류ㆍ경매, 매각) 등이 초래되어 민간수용이 비효율적일 수 있음을 보인다. 그 다음 이러한 비효율 발생을 수치들로써 간단히 제시한 후, 골프장 사례를 통해 이를 실증적으로 검증한다. 분석결과는 민간개발업자에 의한 수용권 남용가능성과 함께 보상액 산정방식 개선 등 민간수용으로 인한 부작용을 최소화할 수 있는 방안에 대한 추가연구의 필요성을 강하게 제기한다. 공공재 공급수단으로서 그 사용이 가파르게 증가하고 있는 민간수용에 대한 정책입안가의 숙고가 절실해 보인다.

영문 초록

The frequency of private takings has increased rapidly in Korea. This paper examines the potential inefficiency of private takings from the economic perspectives and provides empirical evidence by a simple testing methodology. For these goals, we first outline existing legal and economic literature regarding private takings, and point out that two major preconditions in favor of private takings (i. e., public interest and high transaction costs) have never been met occasionally in reality. We further offer the main argument that private takings can cause varying types of inefficiency such as cancellations and delays of public projects even when the two preconditions, on top of two other conditions of just compensation and a superior productivity of the private sector, are assumed to be satisfied. The major tenet is that the private objective of profit maximization can be abused seriously in combination with the incompleteness of legal stipulations and their enforcement. We subsequently show such possibility by investigating the entire cases of constructing golf courses which took place for the past four years. It turns out that supplying golf courses by private takings is not a superior means even compared with market transactions. This result, in spite of an experimental nature of the data and methodology employed, implies that our closer scrutiny is required concerning private takings and their potential harm in the economy.
