국문 초록

국가원수는 대외적 관계에서 그의 국가를 대표하는 최고기관이다. 따라서 국가원수의 국제법상 행위의 효과는 직접 그 국가 자체에게 귀속되게 된다. 특히 국가원수의 행위는 국가의 행위와 마찬가지로 그 특별한 지위에 의하여 타국 법원의 재판관할권과 이에 근거한 소추로부터 면제를 부여받는데, 이를 국가원수면제(Head of State Immunity)라 한다. 종래부터 국가 및 그 통치자는 동일한 존재로 여겨졌기 때문에 국가원수면제는 원래 국가면제의 사상에서 발전되어 왔다. 그런데 국제공동체가 제한적 국가면제의 형태로 발전되었는데, 국가원수면제원칙도 그러한 과정에 따라야 할 것인지 불분명하게 되었다. 그럼에도 불구하고 오늘날 국가원수가 전쟁범죄 등 국제범죄를 범한 경우, 그의 면제특권의 적용을 제한하는 관행과 입법이 증가하고 있다. 국제범죄는 인간이 상상할 수 있는 가장 잔혹한 범죄이며 따라서 이러한 범죄를 저지른 자들을 처벌하는 것은 무엇보다 중요한 일일 것이다. 그러나 현재 국가원수면제의 제한의 구체적인 범위와 정도를 규정한 일반적 조약은 체결되어 있지 않으며, 심지어 국가원수면제가 국제관습법으로 확립되어있는지 여부조차 불투명하다. 따라서 현시점에서 국제범죄를 저지른 전ㆍ현직 국가원수에게 국가원수면제의 예외로서 면제를 부여하지 않는 국제관습법이 성립했는지 여부를 조사하는 것이 매우 중요하다.

영문 초록

Head of State is the highest agency to represent his country in international relationships. Therefore, the action effect of head of state on international law will be directly vested in his country. Especially, his statue of head of state exempts him from the jurisdictions of other state, it is “Head of State Immunity”. The principles of head of state immunity originally derived from the idea of state immunity, as the state and its ruler used to deemed one and the same. As the international community moved toward a restrictive form of state immunity, it becomes unclear whether the doctrine of head of state immunity follow the course as well. Nevertheless today there are growing practices and legislation to restrict his immunity in case head of state commits international crimes. International crimes are the most horrendous crimes thinkable and there ir is important to prosecute the persons responsible of the these crimes. But there isn’t a general treaty that provides a detailed limits of head of state immunity. Even there is uncertain whether head of state immunity is established as not a new principle of customary international law. For this reason, the purpose of this thesis is to investigate whether a new rule of customary international law has evolved that allows for an exception to the head of state immunity regarding violation of international law.
