국문 초록

최근 빠른 환경의 변화로 우리사회에서 아동•학생의 인권문제가 중요한 쟁점으로 제기되고 있다. 본 논문은 국가인권위원회가 지난 10년간 아동•학생의 인권 보호를 위하여 어떤 활동을 하였는가를 인권침해 결정례와 차별시정 결정례를 대상으로 분석하였다. 분석결과 아동•학생에 대한 인권침해가 다양한 형태로 광범위하게 이루어지고 있음을 알 수 있었다. 학생징계 과정에서의 적법절차 원리의 침해가 가장 많았고, 다음으로 체벌로 인한 신체를 훼손당하지 않을 권리, 두발과 복장 규제로 인한 사생활의 비밀과 자유의 침해였다. 차별시정 분야에서는 학력 내지 성적에 의한 부당한 차별이 가장 많았고, 사회적 신분, 장애, 성별에 의한 부당한 차별도 상당수가 있었다. 이러한 분석과 관련하여 국가인권위원회의 향후과제를 몇 가지 제안하였다. 첫째, 아동•학생에 대한 인권침해 결정사례가 전체 결정례에서 차지하는 비중이 매우 낮아 이 분야에 대한 활동 비중을 높여야한다. 둘째, 결정의 실효성을 높이기 위하여 국가인권위원회의 결정이 어떻게 집행되었는지 사후점검을 강화하는 방안이 모색되어야 한다. 셋째, 국가인권위원회의 결정이 이상을 지향하여야 하지만 현장에서 수용이 어려울 정도의 ‘지나친’ 이상적인 결정은 지양되어야 국가인권위원회의 결정에 대하여 신뢰를 얻을 수 있다. 마지막으로 아동•학생의 인권침해는 사전예방이 더 중요한 바, 인권친화적인 학교문화가 조성되도록 정책 토론회 등을 통한 국가인권위원회의 지속적인 노력이 요망된다.

영문 초록

Due to the recent fast-changing social environment, the human rights of children and students have emerged as an important issue in Korea. This article analyzed the activities of the National Human Rights Commission(NHRC) for the last ten years regarding the protection of children and student's human right by looking into NHRC's decisions on civil right violation and discrimination. Regarding civil right violation, violations of the due process of law by disciplinary punishment occurred the most, followed by violation of right to personal liberty when suffering corporal punishment, as well as violation of privacy regarding hair style and outfit regulations. Regarding discrimination, discriminations based on scholastic ability occurred the most, followed by unlawful discrimination because of social position, disability and gender. Based on the above findings, NHRC should focus on the following points. First, NHRC should increase its activities in the field of human rights of children and students, because decisions on this field are relatively extremely low among the total decisions on human rights violation. Second, NHRC should strengthen inspection on how its decisions are actually implemented in order to enhance efficiency. Third, NHRC should consider both the ideal projection of human rights as well as realistic conditions in order to gain credibility. Lastly, NHRC should communicate with civil society and engage in discussions to develop a human right-friendly school environment, because precaution is much more important than reacting to incidents of violation of human rights of children and students after they occurred.
