9ㆍ11이 유엔 집단안전보장체제에 미친 영향

국문 초록

우리는 이 글에서 2001년 9ㆍ11이 유엔 안전보장이사회를 중심으로 하는 집단안전보장체제에 과연 어떠한 영향을 미쳤는가에 대해 살펴보았다. 역사적 개관 특히 9ㆍ11 이전과 이후를 시기적으로 나누어볼 때 후자의 시기에 안전보장이사회 역할수행에 상당한 변화가 있음을 파악하였다. 돌이켜 보건대 안전보장이사회는 자의반 타의반, 1945년 유엔헌장이 예정했던 집단안전보장체제에 변용을 가하면서 국제사회의 안전과 평화유지 임무를 수행하여 왔다. 90년 냉전체제의 종식 이후에는 안전보장이사회가 본래의 기능을 점차 회복하고 있다는 평가도 있었지만, 90년대 이후 발생한 국제적 위기상황에 적절히 대처하지 못한 집단안전보장체제는 여러 가지 문제점과 내부 모순점을 드러내게 되었다. 이러한 가운데 발생한 2001년 9ㆍ11은 안전보장이사회 중심의 집단안전보장체제에 새로운 변화의 필요성을 강하게 제기하였고 실제적으로도 변화를 불러일으켰다고 평가 받는다. 90년대 이후 지속된 안전보장이사회 개혁논의는 결실을 맺지 못하고 있지만, 안전보장이사회는 2001년 9ㆍ11 이후 변화된 안보상황에 맞추어 자신을 계속적으로 변화시켜 가고 있음을 알 수 있다. 가령 대테러 대응방식의 근본적인 변화 시도 및 대량살상파괴무기 확산방지와 같은 시급한 과제에 대응하기 위하여 안전보장이사회는 추상적 일반적 내용을 담은 결의를 채택함으로써 조약과 유사한 이른바 일반규범화를 시도하고 있다. 이러한 안전보장이사회의 변화는 국제적인 안보상황의 변화에 신속하고 효과적으로 대응해야 한다는 요청에 비추어 볼 때 긍정적인 면도 있지만, 부정적 시각도 존재하기 때문에 아직 최종결론을 내리기에는 이르다. 안전보장이사회는 향후 계속해서 국제안보질서체제의 중심에 서기 위해서는 인간안보, 보호책임, 개발 등 새로운 과제에 자기 자신을 적극적으로 적응시킬 필요가 있을 것이다.

영문 초록

In this article, we examine possible impacts on current UN collective security system by September 11th terrorist attacks. To do so, we divide a chronical period in two, i.e, before 9ㆍ11 and after 9ㆍ11. We can conclude that during the latter period, there are quite significant changes in the role of Security Council which is a pivot of collective security system, especially under the Chapter 7 of the UN Charter. Historically, the Security Council has maintained the international peace and security by making changes to its role as it was indicated in the UN Charter. The end of Cold War at the beginning of 1990s provided an environment for Security Council to play its role intended in UN Charter. However, during the transition to the 21st century, facing various international crisis, the collective security system couldn’t manage to resolve effectively them and consequently couldn’t fulfill its purpose. Ironically, the September 11th terrorist attacks signaled a calling for change in collective security system managed by Security Council. Although the UN reform discussion is still facing to many difficulties, the Security Council could manage itself to adjust to the changing international security environments. For example, adopting its resolutions concerning anti-terrorists actions and weapon of mass destruction(WMD), the Security Council seems to do some kind of legislation by using abstract, general terms and obligations towards States. This phenomena is due to not only the requirement of prompt and effective response to the threat on international security and peace, but also relied on the consent given by international community. Until now, the Security Council’s legislator role is limited in certain areas just mentioned above. However we should pay keen attention because it might have an eventual influence onto current international legal order by making a detour of State’s consent or ratification. On the other hand, to keep on maintaining its status as a principal organ for the international community, the Security Council should deal with emerging important issues such as human security, responsibility to protect, and development, etc.
