국문 초록

徽州지역에는 역사가 오래되었고 강한 힘을 가진 宗族組織이 있었다. 그러나 종족의 힘은 太平天國의 亂으로 큰 타격을 받았고 그들은 태평천국의 난 이후 여러 가지 방식으로 자신들의 세력과 권위를 회복하고자 노력하였다. 본 연구에서는 이와 같은 시대적 배경 하에서 同治 8년에 발생한 祠墓訴訟案에 대해 분석하고자 한다. 이 안건은 徽州에서 가장 큰 종족집단의 하나인 汪氏宗族이 連名으로 현지 胥吏 楊良玉이 歙縣 吳淸山에게 개설해준 榨油坊이 汪氏宗族의 祖宗祠墓를 침해한 사건을 소송한 것이다. 본 안건은 1년의 심리 과정을 거쳐 汪氏宗族의 승리로 끝이 났다. 본 연구에서는 汪氏宗族이 승소를 거둔 과정을 상세히 분석하고, 이 소송 과정과 공판 결과가 가져온 영향이 汪氏宗族이 太平天國의 난 이후에 종족이 지역 내에서의 권위를 회복하는 데에 커다란 작용을 했음을 지적하였다. 이 안건은 汪氏宗族이 태평천국의 난 이후 권위를 회복하는 계기중의 하나가 되었다. 이 안건에 대한 분석을 통하여, 太平天國의 난 이후에도 汪氏宗族이 지역에서 권위를 회복할 수 있었던 것은 첫째, 宗族組織의 발달한 사회 네트워크이고, 둘째, 地方保護神과 祖上崇拜라는 이중 신분을 가진 汪華에 대한 영향 때문이었음을 알 수 있었다. 한편으로 汪華는 徽州 汪氏宗族 共同의 祖上으로 종족 내부의 인정을 받았으며, 다른 한편으로 汪華는 徽州 지역의 地方保護神으로서 官方의 지지를 얻었던 것이다. 따라서 汪華의 靈異傳說과 汪氏宗族이 徽州 社會 구조에서의 지위는 매우 밀접한 관계가 있었다고 말할 수 있다.

영문 초록

The article reviewed a law case in 1869 in Huizhou a region with traditional and powerful lineage system. The plaintiff was one of the greatest lineage that Wang lineage, they indicted their ancestor temple was suffered harmfulness from a workshop on oil manufacture owned to a clerk of the Huizhou Prefecture whom named Yang Liangyu. During one year trial with a series of defence, the Wang lineage won the law case, and the victory impacted deeply on the recovering process of the Wang lineage both on power and authority along the Huizhou region after the Taiping Rebelion War. Since the lineage system suffered a hardly weaken according to the Taiping Rebelion War, they seek chances to reconstruct the system. The law case happened in such a background that it reflected the efforts on recovering their own power and authority on the Huizhou region from Wang lineage. The analysis on the law case showed that there were two approaches to recover their power and authority for Wang lineage. Firstly, they had a powerful social network based on an advanced lineage system. Secondly, Wang Hua the ancestor of Wang lineage in Huizhou region symbolized dual means as the lineage ancestor and local god of Huizhou region. In one hand the symbol of Wang Hua made an identity along Wang lineage that constructed their lineage system and social network, in the other hand, Wang Hua as a local god was supported by local government, in another word, the symbol of Wang Hua was related to the status of Wang lineage in Huizhou region.
