가정폭력 담론의 재구축

국문 초록

이 글은 가정폭력 재개념화 논의를 본격화하기 위한 기초연구로서 가정폭력 피해 그리고 가정폭력 피해자를 둘러싼 담론들을 비판적으로 검토하여 가정폭력 재개념화의 논리적 기반을 마련하고, 나아가 향후 연구방향을 제시한다는 목적을 갖는다. 위의 논의를 위해 첫째, 가정폭력 피해자 담론을 주체/피해자 구축에 초점을 두어 논의하는 페미니스트 담론을 살펴본다. 둘째, 법제화 이후 제도권에 의해 구축되고 있는 가정폭력 담론에 초점을 둔다. 특히 가정폭력 피해자 지원과 제도적 조치에 대한 현장 실무자들의 비판과 우려를 통해 정부의 가정폭력 이해의 범주를 살피고 드러낸다. 셋째, 한국사회 가정폭력 담론의 한계를 극복하고, 가정폭력 재개념화를 위해 역량강화 연속선 개념이 그 준거점이 되어야 함을 주장한다. 역량강화 연속선은 가정폭력피해 보호 및 구제, 그리고 예방을 구상하는데 있어 육체적이고 잔인한 폭력발생의 유무를 판단의 기준으로 삼는 현재의 가정폭력 제도화가 상당히 지엽적인 수준에서 가정폭력을 이해하고 있음을 드러내는 개념이다. 이에 역량강화 연속선은 가정폭력 피해자의 역량강화가 일시적이고 임시적인 수준에서가 아닌 연속적인 수준에서 이루어져야 하고, 그로부터 가정폭력의 본질에 대한 본격적 탐구가 시작될 수 있음을 의미하는 개념이다. 이런 점에서 가정폭력이 무엇에 관한 문제인가는 지속적이고도 구체적인 정치적 과제로 인식되어야 하며, 따라서 가정폭력 제도화는 이미 완료된 과제가 아닌 끊임없는 사회적 이해와 법적 해석, 이론적 분석과 정치적 투쟁의 방향과 목적을 구축해야 하는 주요한 장(場)으로 인식 될 필요가 있음을 강조한다.

영문 초록

The purpose of this paper is to suggest the construction and re-interpretation of the discourse of domestic violence in a realistic and fundamental way by exploring the limitations and possibilities of the existing discourse of domestic violence, victims and survivors. In order to discuss these issues, first, this article examines feminist debates on battered women who are identified both as victims and survivors. Second, it pays attention to the domestic violence discourse, especially after institutionalization and state intervention. From the perspectives of feminist activists and advocates, the paper reveals the ways in which contemporary domestic violence discourse has been constructed, negotiated, and regulated by the Korean government. Finally, the article employs the concept of the empowerment continuum for reconceptualization of domestic violence discourse, which reflects the complicated and contradictory experiences of battered women. With the concept of an empowerment continuum, the paper emphasizes the importance of empowering and encouraging battered women in continuous ways that make women prevent, predict, and treat violent relationships in their lifetime. While it is important to understand the contributions of the institutionalization of domestic violence through justifying legal intervention and state support, it also is important to avoid concluding that the issue of domestic violence is under control through this institutionalization. As the article points out, institutional discursive power is strong enough to reconstruct and reinterpret the issue. In this respect, it is significant for feminist research and struggles to directly participate in the process of institutionalization and state engagement in order to stop domestic violence.
