개인정보보호법에 대한 입법론적 검토

국문 초록

개인정보 보호를 위한 여러 개별법 정비의 필요성을 절감하면서도 실현되지 못하던 중, 최근 개정 정보보호법이 제정 공포되어 시행을 목전에 두고 있다. 이번에 제정된 법은 공공부문과 민간부문의 개인정보 보호제도를 모두 아우르고 있다는 점뿐만 아니라 고유식별정보 처리 제한제도, 개인정보 영향평가제도, 집단분쟁조정제도 등을 도입하고 있으며 벌칙 규정도 상당부분 정비하였다는 점 등에서 긍정적인 평가를 받을 만하다. 다만 개인정보 보호업무의 주무관청인 행정안전부장관에게 지나치게 많은 권한을 부여하면서도 보호위원회 등을 통한 통제절차는 미흡한 점, 언론기관ㆍ종교단체ㆍ정당의 개인정보 수집활동을 법적 통제 밖에 두고 있는 점, 본 법과 다른 개별법과의 상충관계를 적절히 조절하지 못하고 있는 점, 공공기관 아닌 개인정보처리자의 개인정보파일 운용을 방임하고 있는 점, 무리한 민사적 특칙을 마련하고 있는 점, 형벌 대상으로 함이 상당한 일부 행위를 과태료 대상으로 설정하고 있는 점, 너무 성급하게 단체소송제도를 도입한 점 등 적지 않은 문제점을 가지고 있는 것도 사실이다. 본 법의 중요성에 비추어 볼 때 법 제정 과정에 충분한 기술적ㆍ법률적 검토와 비판이 제기되지 못한 점이 매우 아쉽고 지금이라도 앞에서 언급한 여러 문제점들에 대하여 충분한 논의와 검토가 이루어져 좀 더 치밀하고 세련된 방향의 보완이 있기를 바란다.

영문 초록

For the protection of personal information, We were faced with the necessity of various individual laws's modification. Nevertheless, it is not unrealizing. But recently The Privacy act was established and promulgated, it facing enforcement. The established bills deserve positive assessment. Because it encompassing to all personal information protection system, not only public sector but also private sector. Besides, it is introduct identification information processing limit system, privacy effects evaluation system and collective dispute mediation system. and it has modified large portion of the penal provisions. But it also has its considerable problems. that is giving too much power to the minister of public administration and security, who is the competent authorities of privacy practices. while the control procedure by the protection committee is insufficient, and the activities for collecting personal information by Media organizations, Political parties and Religious groups were not controlled legally, and it doesn't control properly, conflict of between this law and other various individual laws. neglecting the management of personal information file by the manager of personal information, not public institution. prepare unreasonable special civil law, Setting some act for fine instead of criminal process. In the light of this law's importance, I'm so worried about there's no technical and legal review and criticism. I hope more careful and elegant legislation through the enough discussions and reviews about the various issues as I mentioned before.
