국문 초록

집회 및 시위는 타인과 의사를 형성ㆍ표현하기 위해 공동의 이익과 목적을 추구하는 헌법상 보장된 기본권이다. 그러나 집회 및 시위의 주최자나 참석자들은 그 방법의 정당성ㆍ적법성 보다는 사회적 여론과 다중의 위세를 이용하여 요구사항을 관철시키고자 한다. 따라서 집회 및 시위가 투쟁적 성격으로 남발되고 다양화되면서 과격돌출행동으로 불법ㆍ폭력시위가 발생하게 된다. 경찰은 이러한 불법ㆍ폭력시위로부터 국민의 생명ㆍ신체ㆍ재산 등 기본권을 보호할 의무가 있으며, 반면 합법적인 집회 및 시위의 자유는 적극적으로 보장하여야 한다. 그런데 집회 및 시위 참여자들은 자신들의 주장을 관철시키기 위하여 노력하는 반면, 경찰은 구체적인 집회 및 시위의 목적을 불문하고 빠른 시간내에 평화적인 종료를 원하기 때문에 양자간에 충돌이 발생하게 된다. 그러나 집회 및 시위와 관련된 정치적ㆍ사회적 여건의 변화에 따라 정부와 경찰, 언론 및 시민단체 모두는 집회 및 시위에 대한 인식과 역할이 바뀌어야 할 것이다. 이에 따라 정부는 공공갈등 해결을 위한 새로운 패러다임을 구축하여야 할 것이고, 경찰은 법률상 집회 및 시위관리에 있어 경찰권의 발동 및 그 한계에 관하여 재점검 할 필요가 있다고 본다. 또한 언론이나 시민단체도 역할인식을 새롭게 하여 공정한 보도와 집회 및 시위가 가지는 사회적 의미에 대해 인식전환의 계기를 마련하여야 할 것이다. 본고에서는 집회 및 시위와 관련하여 논란이 될 수 있는 몇 가지의 문제에 대하여 경찰권 발동과 관련하여 그 대응방안에 관하여 검토하였으며, 이와 동시에 외국의 집회 및 시위에 관한 내용을 검토하여 그 개선방안을 제시하고자 하였다.

영문 초록

The Assembly and demonstration is right of constitution which pursue profit and goal of commonness. But the sponsor or the attendees of assembly and demonstration have precedence for the requirement of the themselves. Consequently, the assembly and demonstration became various anger and diversification and with radical projection conduct, the fire legal violent of force is spreading. For these illegal and violent police must protect the life and body and property etc. fundamental right of the citizen. Simultaneously, police must guarantee the freedom of the assembly and demonstration which is legitimate. By the way participants of assembly and demonstration endeavor in order to accomplish the assertion of the themselves. But the police wish it will be prompt and peaceful. Consequently, the collision occurs to between two, but the political and social circumstances which relate with assembly and demonstration is change. Consequently, the government, police, press, the civil society all must be exchanged about the recognition and role of the assembly and demonstration. The government must construct a new paradigm for the public conflict resolution. And the police will be institutional and must rearrange inspect for the legal assembly and demonstration. Also, the press or civil society must do role recognition newly. Consequently, the recognition of the fair assembly and demonstration will be converted. This paper explained these problem points. Namely, first observed of contents of our country assembly and demonstration. And observed confrontation plan of the foreign nation. Last presented the problem point and improvement program of confrontation plan. In short, ① The peaceful assembly and demonstration are few dangerous for the stability order of the general public. To like this case the police must induce in order to autonomously manage. ② Illegal violent demonstrations are dangerous for the stability order of the general public. To like this case the police must strictly handle. and ③ Recently, new type assembly and demonstration can be regulate according to the other law. and ④ About the transformed assembly and demonstration is necessary legislation complement.
