대통령의 헌법상 권한은 과연 강력한가?

국문 초록

현행 헌법상 대통령에게 제왕적 권한이 부여되어 있다는 비판이 일반적으로 받아들여지고 있다. 이러한 비판은 과연 정당한 것일까? 본 논문은 Shugart 와 Carey, Hellman과 Frye, Metcalf와 Roper, Siaroff 등 대통령의 권한강도를 계량적으로 측정한 다양한 선행연구들을 참고하여, 현행 헌법상 대통령 권한의 강도를 측정하고, 이를 토대로 국무총리의 헌법상 권한의 강도를 간접적으로 추정했다. 그 결과, 반 대통령제 정부형태를 주요 비교대상으로 한 Hellman과 Frye의 측정이나 Metcalf의 측정을 제외하고는, 우리 대통령의 헌법상 권한이 ‘상대적으로’ 극단적 우위에 있다는 실증적 근거는 발견되지 않았다. 아울러 국무총리의 권한 역시 과도하게 취약한 수준은 아닌 것으로 추정되었다. 현행 헌법상 대통령의 강력한 지위와 국무총리의 취약한 지위는 대통령이 국무총리 및 국무위원=장관을 임의로 해임할 수 있도록 내각해임권이 보장된 데 기인한 것으로 판단되었다. 즉, 현행 헌법상의 대통령은 좁은 의미의 정부=내각(국무총리 및 국무위원=장관)에 대한 관계에서 ‘제왕적’인 지위에 있고, 현행 헌법상의 국무총리 또한 대통령 및 그의 지배를 받는 국무위원=장관에 대한 관계에서 ‘유명무실’한 지위에 있다는 것이다.

영문 초록

There still exists a common fear of the “imperial presidency” among Koreans. Is Korean presidency really so powerful that it calls for a constitutional revision to change government structure, from presidential to parliamentary or semi-presidential system? To answer the question, I examine some quantitative researches that assess the power of the presidency. Here, to assess the Korean presidency, I adopt Shugart and Carey’s measuring method, Hellman and Frye’s checklist method, Metcalf’s and Roper’s revisions to Shugart and Carey’s method, and Siaroff’s checklist method. According to Hellman and Frye’s method and Metcalf’s method, the Korean presidency seems to be quite strong, but compared only to the semi-presidential systems. I cannot find any significant evidence for the “imperial presidency” of the current constitution. And the constitutional power of the prime minister is not so weak as people think. The strong presidency and the weak premiership is mainly due to the fact that the president has exclusive power over cabinet dismissal. My conclusion is that the Korean presidency is “imperial” in relation to the cabinet, and that the Korean premiership is “nominal” in relation to the president and his/her cabinet.
