국문 초록

지난 반세기 동안 세계 총생산액은 8배 증가한 반면 세계무역량은 거의 20배 정도에 달하는 괄목할만한 증가를 일궜다. 국제무역의 대금결제에 사용되는 신용장제도는 보편적으로 신용장통일규칙을 근간으로 하여 해석되고 적용된다. 오늘날 급변하는 세계환경과 빠른 속도로 성장하고 있는 세계경제는 국제 무역환경의 변화를 요구한다. 최근 예측불허의 어려운 상황들과 심각한 피해 등 불가항력적인 요소가 연이어 발생하고 있다. 무엇보다 국제무역에 사용되는 대금결제제도는 안정성이 우선시 고려되며 이러한 불가항력 사유가 발생할 경우 신용장제도와 그 사용의 유용성에 상당한 영향을 미칠 수 있을 것으로 여겨진다. 따라서 1933년에 제정된 신용장 통일규칙상의 불가항력 면책조항이 그동안 어떻게 변화되었는지를 살펴보고 이를 바탕으로 관련조항의 해석과 거래관습을 통해 이 조항의 적용에 따른 당사자들의 영향과 문제점을 검토하고자 한다. 나아가 본 조항이 보다 더 시기적절하고 합리적인 조항이 되도록 자체적인 문제점과 올바른 방향성을 모색하고자 한다.

영문 초록

The purpose of this study is to examine the Force Majeure Disclaimer Clause in the UCP which was made by ICC and have been applied to the letter of credit. Since 1933, ForceMajeure Disclaimer Clause almost hasn't changed except a fewwords which are added "civil commotions, insurrections, any strikes or lockout and acts of terrorism", even the international trade volume has increased about 20 times than 70 years before and theworld economic condition has been changing rapidly. Under this circumstance, I checked out that the first change of this Force Majeure Disclaimer Clause itself, second the problems of parities when appling this clause and it is found that it's possible to be a harmful parity for the exporters who are the beneficiary and the next onewill be the confirming bankwithout having any recourse under the L/C. So with above viewI present themore reasonable directions of the UCP as follows: 1. ForceMajeure Disclaimer clause should be applied and interpreted very strictly to the bank which is the beneficiary under the this disclaimer clause. 2. Both of importers and exporters should better do prepare the countermeasures of the pooling systemfor the loss under the force majeure Disclaimer clause applied by the bank. 3. There's no good reason why this article in the UCP exists. In this field, the ForceMajeure Disclaimer clause was built by judicial precedents and practices.
