국문 초록

본 논문에서는 정보사회의 도래와 전자정부의 등장에 따른 행정정보공동이용으로 인하여 헌법상 보장되는 기본권인 개인정보의 보호와 자기정보관리통제권의 정립가능성을 모색하고, 보장의 내용 및 한계와 제한을 기본권 보장의 체계적 측면에서 구체화하며, 나아가 이러한 기본적 이해를 바탕으로 하여 헌법적 근거와 법률체계의 구체적 내용과 문제점을 검토하고자 하였다. 그리고 결과를 토대로 전자정부 구축에 따르는 ‘행정정보공동이용’과 ‘자기정보관리통제권’이라는 서로 상충될 수 있는 두 개의 법적 가치가 각각의 기능을 충분히 발휘할 수 있는 법제정비 방안의 도출 및 보다 바람직한 입법방향의 제시를 목적으로 연구하였다. 헌법상 보장되는 정보인권의 보호를 위해서는 개인정보침해를 사전적으로 예방하거나 사후적으로 구제하기 위한 법제의 정비와 이에 못지않은 보안 시스템이나 보안 프로그램의 개발과 같은 기술적 차원의 연구개발도 중요하다. 하지만 여기서는 규범적 차원에서 개인정보보호 및 자기정보관리통제권에 대한 법제도적 보호방안에 주안점을 두고 규범적 방법에 입각하여 연구를 진행하였다. 더 나아가 자기정보관리통제권의 확보를 위해서는 정보주체가 자신의 정보에 대해 익명 또는 삭제를 청구할 수 있는 한편, 정보처리상황에 대해 설명을 들을 권리를 보장하며, 전산화에 의하여 확대되는 조직의 권력을 적절하게 통제하여 개인정보의 남용을 억제하기 위한 외부통제의 기능을 수행하는 독립된 개인정보보호기구를 설치할 필요가 있다고 본다. 그리고 전자정부를 운영함에 있어서는 사전영향평가제가 도입되어 개인정보를 수집하기 전부터 개인정보 침해문제를 미연에 방지하고 나아가 국가 예산절감의 효과도 동시에 만족할 수 있는 방안을 고려하는 것도 필요하다.

영문 초록

The purpose of this study is ⅰ) to search for the possibility of establishing the personal information protection and the individual's right to personal information management and control as fundamental rights of the constitution through the introduction of the administration information sharing with the advent of the era of information society and electronic government, ⅱ) to specify the content of and restrictions on the guarantee of those fundamental rights in a systematic way, ⅲ) to examine the constitutional basis, and the specific contents of and problems of the law system, and thereby, ⅳ) to suggest measures to improve the legislative system, and more appropriate future direction of legislation so that the two values, 'administration information sharing' and 'the individual's right to personal information management and control,'become able to fully function, otherwise they might conflict with each other in the process of the establishment of electronic government. In order to protect human rights to information guaranteed by the constitution, what is most needed is prevention of personal information infringement and improvement of legal system to provide remedy for it. The technical research and development of security systems and programs is also imperative. The main focus of this study is, however, on the protection of personal information at a normative level, and on the legal ways to secure the individual's right to personal information management and control. From a more fundamental point of view, to pursue this goal, it is regarded as necessary to set up the independent organization for personal information protection that plays the role of external security control against personal information abuse by increasingly expanding power of organizations due to computerization. Through the organization, the agent of the information provided would hopefully be guaranteed the right to demand anonymity or deletion of his or her own information and the right to be provided with explanation of the information processing state. Besides, the introduction of the preliminary examination system of the effect should be considered in operating e-government to keep personal information violation from occurring and to reduce the national budget at the same time.
