아동의 권리실현을 위한 인권교육에 관한 고찰

국문 초록

우리나라는 아동의 권리에 대한 이해의 폭을 넓히며 아동을 물질적.정서적으로 보호하기 위하여 많은 노력들을 경주하고 있다. 이 같은 노력의 목적은 ‘모든 어린이가 차별 없이 인간으로서의 존엄성을 가지고 나라의 앞날을 이어나갈 새 사람으로 존중하며 바르고 아름답고 씩씩하게 자라도록 하는 것이며 이들이 ’인간다운 삶을 보장받고 스스로 행복을 가꾸며 살아갈 수 있도록 여건과 환경을 조성해 주는 것‘이다. 이에 우리 정부의 아동권리에 대한 인식 역시 아동의 권리 에 관한 국제협약의 정신과 일치하고 있으며 이는 대한민국이 취하고 있는 아동과 관련된 여러 법적, 제도적, 행정적 조치에 구체적으로 나타나 있다. 또한 아동의 건전한 가치함양과 지식의 계발을 위하여 교육 부문에 많은 투자를 하여 아동의 권리신장을 위한 꾸준히 노력을 경주하고 있다. 그러나 아동의 권리보장과 복지를 위하는 여타의 노력에도 불구하고 아동의 권리가 완벽하게 실현되고 있다고 평가할 수는 없다. 아동의 권리는 일반적으로 성숙한 인격체로 완성될 때까지 아동을 둘러싼 여타 환경에서의 제반적인 변화가 수반되었을 때에야 비로소 질적인 차원의 아동권리가 실현되었다라고 볼 수 있을 것이다. 그러기 위해서는 아동을 위한 보다 집중적인 인권교육이 필요하다. 우리는 세계인권선언을 항상 마음에 간직한 채 우리의 미래세대인 아동자신들에게 가장 최선의 이익은 무엇이며, 무엇으로 자신들의 삶의 주인이 될 수 있는지를 스스로 판단할 수 있도록 다양한 권리교육을 통해 그들 자신들의 권리와 자유에 대한 스스로의 존중을 신장시킬 수 있는 적극적인 기회를 보장해 주어야 할 것이다.

영문 초록

In the preamble of the Universal Declaration of Human Rights, it says that ‘All the individuals and members of society are asked to raise the respect for human rights and liberty through the education’, and in article 26, right of education is asserted and also it clarifies that the purpose of education is ‘to consolidate the respect for human rights and fundamental freedom’. In these senses, human rights education for realization of children's rights is not the selection but rather the educational process obviously to be fulfilled. The phenomenon that the subject, ‘human rights of child’ is gradually being thrown into relief recently in our society is indeed desirable at the aspect of the materialization of realizing substantive democracy, and furthermore, it is absolutely truth that the education to enhance the sense of human rights for children, the leading roles in future is the very urgent one to be resolved. However, in comparison with the criteria for the rights of child emphasized by the United Nations convention on the rights of the child, current status of South Korea would be at primary level. Human rights education shall make children understand the truth related to human rights and have them fulfill the norms expressed as human rights psychologically or behaviourally, and simultaneously surroundings of children also shall be altered to an appropriate for realization of human rights. Particularly, the treatments violating the human rights to child, the main agent of study can be mentioned with various types and categories from corporal punishment overtly conducted under the name of discipline to the organizational contradiction of secondary education even called ‘Examination hell’ in our country, and the improvement of human rights in the environment of school education is the task to be combined with human rights education for children and both are shall be resolved. Since children are the very main agents of children's rights, and the value of human rights is not only the right of the individual but also the obligation of individual.
