국문 초록

본 연구는 특수학교 교육과정과 교과용도서에 대한 법적 규정의 분석과 그에 대한 문제를 살펴봄으로써 현행 입법을 대체하는 개선방안 탐색의 토대를 마련하는데 목적을 두고 있다. 이 목적을 위해 논의된 내용은 첫째, 특수교육 대상자의 권리와 해당법의 특별법적 성격에 대해 논의하였다. 일반교육 대상자뿐만 아니라, 장애인 등의 특수교육 대상자 역시 교육의 기회에서 복지형 배분 원리를 지니고 있기 때문에 국가의 적극적 지원과 개입이 요구되었다. ‘장애인 등에 대한 특수교육법’은 ‘유아교육법’과 ‘초․중등교육법’에 비해 특별법적 성격을 지니고 있기 때문에 교육과정과 교과용도서에 관한 규정이 있다면, 우선적으로 적용되는 성격을 지니고 있었다. 둘째, 특수학교 교육과정과 교과용도서에 대한 법규 현황에 대해 살펴보았다. 여기서는 ‘장애인 등에 대한 특수교육법’과 동법 시행령, 그리고 일반교육에 해당되는 법으로서 ‘유아교육법’과 ‘초․중등교육법’에 대한 사항을 분석하여 특징적인 면을 정리하였다. 특징적인 면은 곧 교육과정과 교과용도서에 대한 문제와 마찬가지였다. 마지막으로 특수학교 교육과정과 교과용도서에 대한 교육법학적 검토를 수행하였다. 여기서는 교육과정과 교과용도서를 분리하여 논의하였다. 교육과정의 경우는 ‘장애인 등에 대한 특수교육법’에 규정이 되어 있기 때문에 일반교육 관련 법에 대해 특별법적 인정을 받고 있었다. 논의 내용은 교육과정 결정구조, 일반학교 교육과정과의 관계, 교육과정 내용의 조정 사항이었다. 교과용도서에 관한 사항은 ‘장애인 등에 대한 특수교육법’에 제시되어 있지 않기 때문에 ‘초․중등교육법’과 ‘교과용도서에 관한 규정’의 적용을 받는 구조였으며, 교육과정과 교과용도서의 관계, 교과서 저작, 교과서 채택과 사용에 대한 검토를 행하였다. 논의 결과 특수학교 교육과정과 교과용도서에 대한 규정은 ‘장애인 등에 대한 특수교육법’에 동시에 제시하는 방법을 강구할 필요가 있었다. 구체적인 내용에서 특수학교 교육과정 규정은 일반학교 교육과정 규정과 조화될 수 있는 법적인 정비가 필요하였으며, 교과용도서의 경우는 국가의 지원 역할을 강화하는 방향으로 규정되어야 할 필요가 있었다.

영문 초록

This study attempted to explore legal issues and problems related to curriculum and curriculum books for children with disability. For this end, first, the nature of the rights to receive education for children with disability and the legal characteristics of ‘Act on Special Education for the Disabled Persons’ were reviewed. the nature of the rights to receive education for children with disability is a kind of the rights for welfare. And ‘Act on Special Education for the Disabled Persons’ appeared to be superior to the ‘Elementary and Secondary Education Act’ in order to ensure the rights of the children with disability to receive a proper education. Second, the differences between ‘Act on Special Education for the Disabled Persons’ and ‘Elementary and Secondary Education Act’ were analyzed. It was found that the regulation of curriculum are not in keeping with the curriculum books. The curriculum of special school was subject to the ‘Act on Special Education for the Disabled Persons’, and the curriculum books was covered by ‘Elementary and Secondary Education Act’. Third, It was discussed legal examination related to curriculum and curriculum books in special education. The decision-making of curriculum, the relations between the curriculum of the general education and special education, reconstruction of the curriculum, the relations between the curriculum and curriculum books, the writing of curriculum books, and selection and supply of curriculum books were examined. In conclusion, further attentions to legal imperatives in special education need to reconstruct regulations related to curriculum.
