국문 초록

본 연구의 목적은 제18대 국회에서 발의된 폴리페서 규제법안들의 헌법적합성 여부를 검토하는 것이었다. 본 연구의 주요 결과는 다음과 같았다. 첫째, 이 법안들은 대학교원들의 정치 참여에 대한 규제에만 초점을 맞추고 있었을 뿐, 복직에 관한 규제는 간과하였다. 둘째, 사직 대상을 국ㆍ공립대학교원으로 제한하는 것, 사직 사유를 공직 선거의 후보자, 국회의원, 정무직공무원 등으로 제한하는 것, 공무원 및 언론인과 달리 국⋅공립대학교원에게만 휴직을 허용하는 것, 그리고 휴직 회수를 제한하는 것은 평등원칙에 위반되지만, 사직 시기를 임기개시일 후 1년 이내로 하는 것은 평등원칙에 위반되지 아니 한다. 끝으로, 휴직 회수의 제한 및 사직 시기를 당선 확정 후로 할 경우 사직의 의무화는 직업선 택의 자유 및 공무담임권을 침해하지 아니 한다.

영문 초록

The major purpose of the study is to review whether the bills for regulating the polifessor are constitutional. The major findings are as follows. First, the bills focused only on the regulation of professor's political participation instead of that of resuming the professor after finishing the office. It seemed to result from the fact that these bills emphasized the resignment of the polifessor instead of the temporary rest of the professor. Second, considering the infringement of the student's right to learn, the restriction of the subject of the resignment for beginning the office to the professor at the public university, the restriction of the reasons for the resignment of the professor to the candidate for the public officer, the Congressman, and the political civil service, the permission of the temporary rest to only the professor at public university, and the restriction of the frequency of the temporary rest of the professor violate the equal protection clause. However, the restriction of the time of the resignment of the professor to within one year after beginning the office does not violate this clause. Last, considering the extent of the infringement of the student's right to learn, the mandatory resignment of the professor after beginning the office does not violate the polifessor's freedom of vocational choice and public service.
