전·의경 의문사의 발생원인 분석

국문 초록

우리나라에서 대간첩작전 및 시위진압, 치안보조업무를 주요 임무로 하는 전․의경 제도는 대간첩작전 인력을 보강하기 위해 1970년 12월 31일 전투경찰대설치법이 제정되면서 기존에 일반경찰관으로 구성된 전투경찰이 병역의무를 대신하는 병력자원으로 전환된 것에서 비롯된다. 그런데 2009년 한 해 동안만 해도 경찰병원에서 치료를 받던 의경이 부대 복귀를 하루 앞두고 자살을 하는가 하면 지방경찰청 기동단 소속 의경과 쌍용자동차 시위 진압 당시 투입되었던 의경이 투신 자살하는 등 전․의경 사망사고가 끊이지 않고 있다. 특히 이러한 사망사고에 있어서 선임병들에 의한 구타나 가혹행위, 기타 부대 내 문제가 영향을 미친 것은 아닌지 의혹이 제기되는 경우가 많아 소중한 젊은 생명의 손실과 더불어 국가의 병역제도와 사망사고 처리과정에 대한 국민의 불신을 가중시키고 있다. 이러한 전․의경 사망사고를 예방하고 억제하기 위해서는 철저한 조사를 통해 사인(死因)을 명확히 하고 그에 합당한 보상조치를 사후적으로 하는 것도 중요하지만, 보다 근본적인 대안을 마련하기 위해서는 기존 사건들에 대한 구체적 분석을 통해 그 발생 원인을 규명하는 노력이 선행되어야 할 것이다. 따라서 이 연구에서는 2006년 창설된 대통령소속 군의문사진상규명위원회에 접수된 진정사건 중에서 ‘진상규명’ 결정이 이루어진 사례를 면밀히 검토․분석하여 그에 대한 정책적 시사점을 도출하고자 한다.

영문 초록

AP/CP system has the main mission of counterespionage activities, suppression of demonstration and assistance of public securities, and started as combat police that consisted of ordinary police officers was converted to military forces substituting military services with enactment of Combat Police Act on Dec. 31, 1970 in order to reinforce workforce for counterespionage activities. In the mean time, there are many cases of deaths of auxiliary police and combat police for one year of 2009, including the cases that the auxiliary policeman who received treatment at policeman hospital committed suicide 1 day before returning to the military unit; the auxiliary policeman under Maneuver Group of Provincial Police Agency and the policeman who was deployed to suppression of Ssangyong Motor demonstration committed suicide. In particular, suspicions are raised regarding whether such deaths were affected by beating or severe treatment of senior soldiers or other problems of the unit, aggravating the distrusts of people on national military system and handling of death accident, as well as loss of valuable young life. To prevent and restrain the accident cases of combat police and auxiliary police, it is important to clarify the cause through exhaustive examination and to take reasonable actions for compensations. However, to prepare more fundamental solutions and alternatives, it should be reinforced with efforts to analyze the causes of generation through concrete analysis on existing cases. In this regard, this study aims to closely examine and analyze the cases that were received at Presidential Truth Commission on Suspicious Deaths founded in 2006, and received determination for “clarification of truth”, thereby deriving the suggestions in terms of policy.
